SUBJECT:

REQUEST TO THE DEPARTMENT OF HEALTH AND HUMAN SERVICES REGARDING MODIFICATIONS TO THE FITNESS-FOR-DUTY PROGRAM The Commission's staff requirements memorandum (SRM) of March 22, 1989, asked the staff to explore further the need to amend 10 CFR Part 26 to add benzo.

diazepines and barbiturates to the testing protocol ar.d to lower the cutoff levels for marijuana and amphetahdnes. The SRM also directed the staff to request the Secretary, Department of Health and Human Services (HHS), to review the merits of including the additional drugs and lowering the cutoff levels in Federal guidelines. To assure appropriate consistency with testing programs for Federal employees, the staff was asked as a separate matter to request the Secretary, HHS, to consider adopting these changes for NRC and other Federal programs.

The staff has held several conversations with the staffs at the National Institute on Drug Abuse (NIDA) and the Department of Justice and they strongly advise that we combine these actions but permit the lower cutoff levels and the addition of the drugs to the testing protocol to be addressed as separate issues. The enclosed letter to the Secretary HHS, adopts these recommen-dations.

We understand that NIDA is initiating the ac ion we are requesting, based upon several other requests and the technical merits of the action. However, as there is not unanimous support at NIDA and/as the key individual who does support it is leaving sooa, the NIDA staf advises us to forward the enclosed letter quickly.
