Pursuant to the agreement between the Nuclear Regulatory.
CommisFicn ("NRC" or "CommisFion") and.the Department of Justice j
("DCJ"), this letter wi31 inform you of a third-party subpoena i
received by the NRC which requests docume,nts referred to the DOJ in connection with a potentini criminal violation.
Attached is a subpoens served upon Samuel J. Chilk, the Secretary of the Commission, which seeks documents related to the Commission's order of Perch 31, 1987, which directed an incediately effective shurcown of the Peach Bottom Atomic Power Station.
The NRC's Office of Investigations ("OI") referred two Reports of Investigations related to that order, ROI 1-87-003 and ROI 1-87-003-S, to your cifice on December 9, 1987, for DOJ review of j
potential violations of federal law and possible prosecution.
Documents which are responsive to the attached subpoena request were among those documents forwarded to the DOJ in that packsge.

f Under the hRC's litigation policy, this office coordinates the agency's response to such requests with your office when those requerts seek documents or information related to ongoing DOJ investigations or putential DOJ prosecutions.
OI advises this' Office that the attorney handling this-action in the U.S..
