~ On May 7,1998, Region I conducted a predecisional enforcement conference with Breitling, USA, Inc. Mr. Pangburn opened the conference by stating that the purpose of the meeting was I

to provide the licensee an opportunity to discuss the events surrounding the apparent violation.-

and provide any additional information that the NRC should consider in its enforcement deliberations including corrective actions that Breitling has taken. ' Ms.' Joustra explained that the NRC would like to understand the chain of events surrounding Breitling's discovery of the need for an NRC license.' Ms. Minnick discussed the apparent violation involving the possession, use, and transfer of byproduct material without an NRC license.

Mr. Brown confirmed that a violation had occurred, namely Brietling's possession, use and distribution of tritiated watches without an NRC license. Mr. Brown summarized the events as he understood them regarding how the company became aware of the need for an NRC license to possess and distribute tritium watches. He stated that Breitling was rot familiar with NRC requirements for a license. The company began a process of gathering information from other watch companies and radiological consultants in November 1997 due to an inquiry from their parent company in Switzerland regarding regulations in other countries. The NRC called Breitling on February 26,1998 and determined that Breitling had been distributing watches containing tritium without the required licensing. In response to a Confirmatory Action Letter (CAL), the company ceased distribution and repair of watches until they obtained an NRC license. They also filed for an NRC possession license and a distribution license, and hired a radiological consultant to perform wipe tests and decontaminate,their facility.' Mr. Brown summarized their corrective actions, which included hiring a radiological consultant to set up a

. radiation protection program at their site, perform bioassays of workers, perform weekly visits, and provide training to workers.

. Mr. Holody then explained the enforcement options available to the Commission.
