Karl Abraham Stephen Horwitz NRC APPEAL BOARD TO HEAR ORAL ARGUMENT IN SHOREHAM PROCEEDING ON JANUARY 25 IN BETHESDA, MD An Atomic Safety and Licensing Appeal Board will hear oral argument January 25 in Bethesda, MD, on a portion of appeals from a Licensing Board's concluding initial decision of September 23 in the NRC's operating license proceeding for the Shoreham nuclear power plant near Brookhaven, New York.

The interveners, Suffolk County, the State of New York and the Town of Southampton, appealed the Licensing Board decision that, among other things, found the governments in default of its orders on discovery and dismissed them from the proceedings. On November 9, the NRC Commissioners directed that appeals from the Licensing Board decision dismissing the governments be certified to the Commission for a decision on whether the conduct of the governments warranted dismissal from the proceeding. Other matters in the Licensing Board decision--in particular role conflict of bus drivers and the emergency broadcast system--remain before the Appeal Board.

Argument will begin at 9:30 a.m. in the NRC Public Hearing Room 5th Floor, East-West Tower Building, 4350. East-West Highway.

Participants will include representatives of Long Island lighting Company, the interveners and the NRC staff.

Members of the Appeal Board hearing the case are the following Administrative Judges from the NRC's Appeal Panel:

Christine N. Kohl, chairman; Alan S. Rosenthal and Howard A. Wilber.
