Dear Mr. Darke:

This is to inform you that we can take no action on your recent undated letter, copy enclosed, which we have assigned request number F01A-89-136, until you provide written clarification on the scope of your request.

Your letter is unclear as to whether you are seeking all records not publicly available regarding the financial surety summary enclosed with your letter or all records not publicly available regarding the licensees listed in the financial surety summary. Also, your letter is unclear as to whether by stating " records not publicly available" that you are seeking records identified in NUDOCS as central files records or any other records.

Further, it is unclear whether the intent of your request is to in fact request copies of agency records or your intent is to seek establishment of Local Public Document Rooms (LPDRs) for all referenced sites.

For your information, the Freedom of Information Act (F0IA) applies to requests for agency records; it is not a proper forum to further other purposes such as requesting establishment of LPDRs. Also, as we reccMb informed you, by letter dated March 14, 1989 regarding F01A-88-401, the FOIA requires that a requester specifically describe requested records (5 U.S.C. 552(a)(3)). Further, the NRC determines whether to waive fees only upon a request pursuant to 10 CFR 9.41.

Your statement that your provision of information sought by 10 CFR 9.41 "would result in destruction of NRC record" is also unclear.

Please note that NRC staff informed this office that most if not all records related to the financial surety summary have already been nade publicly availabia at NRC's Publ#c Document Room and the Uranium Recovery Field Office.

A request for "all records not publicly available," other than AUDOCS " central files" designated rccords, is r.ot a reasonable description of rec-ards but is, instead, a broad, indiscriminate request for production of records. Also, please note that in many cases central files records may ne proprietary recorns of licensees which are not released under F0IA requests.

If you intend your revest to cover NUDOCS " central files" records for certain licensen, you it,ay wish to reouest copies of those NUDOCS central files records which are rot proprietary records.

Upon receipt of written clarification of the scope of your regtest, this office will ask NRC staff to provide estimates of necessary effort to locate and copy requested records. We will then provide to you a notice of est'uated l

fees for NRC to locate requested records and provide copies to you.

If you

This is to inform you that we can take no action on your recent undated letter, copy enclosed, which we have assigned request number F01A-89-136, until you provide written clarification on the scope of your request. Your letter is unclear as.to whether you are seeking all records not publicly available regarding the financial surety summary enclosed with your letter or all records not publicly available regarding the licensees listed in-the financial surety sumary. Also, your letter is unclear as to whether by stating " records not publicly available" that you are seeking records identified in NUDOCS as central. files records or any other records. Further, it is unclear whether the intent of your request is to in f act Local Public Document Rooms (LPORs) your intent is to seek establishment request copies of agency records or for all referenced sites. For your information, the Freedom of Information Act (FOIA) applies to requests for agency records; it is not a proper forum to further other purposes such as requesting establishment of LPDRs. Also, as we recently informed you, by letter dated March 14, 1989 regarding F01 A-88-401, the FOIA requires that a requester specifically describe requested records (5 U.S.C. 552(a)(3)). Further, the NRC determines whether to waive fees only upon a request pursuant to 10 CFR 9.41. Your statement that your provision of information sought by 10 CFP, 9.41 "woulo result in destruction of NRC record" is also unclear. Please note that NRC staff informed this office that most if not all records related to the financial surety summary have already been made publicly available at NRC's Public Document Room and the Uranium Recovery Field Office. A request for "all records not publicly available," other than NUDOCS " central files" designated records, is not a reasonable description of records but is,- instead, a broad, indiscriminate request for production of records.

Also, please note that in many cases rentral files records may be proprietary records of licensees which are not released under F0IA requests. If you intend your l

request to cover NUDOCS " central files" records for certain licensees, you may wish to request copies of those NUDOCS central files records which are not l l proprietary records. ~ Upon receipt of written clarification of the scope of your request, this office will ast NRC staff to provide estimates of necessary effort to locate l and copy requested records.
