PROPOSED IMPOSITION.0F CIVIL. PENALTY - $750 l
' This is to inform the Comission that a Notice of Violation and_ Proposed Imposition of Civil Penalty in the amount of Seven.Hundred Fifty Dollars ($750) will be issued on or about May 31,1989 to Niagara of Wisconsin Paper Corporation, Niagara,. Wisconsin. This action is based on two violations which involved:
(1) failure to have licensed individuals perform the removal of a generally-licensed radioactive gauge from its installed location, and (2) transfer of a radioactive gauge to an' unlicensed metal salvage yard. The base civil penalty amount was increased by 50% because the licensee's corrective actions were not timely.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice May 31, 1989-Telephone Notification of Licensee May 31, 1989 The State of Wisconsin will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
