April 13,1998 EN 98-025 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:
Overhoff Technology Corporation EA 96-242 Milford, Ohio
Subject:
PROPOSED IMPOSITION OF civil PENALTY - $2,500 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $2,500 will be issued on or about April 16,1998 to Overhoff Technology Corp., Milford, Ohio. This action is based on a Severity Level 111 problem that involves shipment of devices containing tritium in excess of the exempt quantity, in violation of the Licensee's distribution license. Because these issues were reviewed at length with the Licensee during the licensing process, and based on the conclusions of a report by the Office of Investigations, the staff concludes that the violations demonstrate careless disregard.
Because the violation involves careless disregard, the staff considered whether credit was warranted for both Identification and Conective action. Credit foridentification was not warranted because the violations were identified during an NRC inspection. Credit for corrective action was warranted based on the Licensee's actions as described in the Notice.
Therefore a civil penalty in the amount of $2,500 is being proposed.
It should be noted that the Licensee has not been specifically informed of the enforcement action. The schedule ofissuance and notification is:
Mailing of Notice April 16,1998 Telephone Notification of Licensee April 16,1998 The State of Ohio will be notified.
The Licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
