As requested, Baltimore Gas and Electric is providing a report that describes our response to NRC Bulletin 88-10. The bulletin required that licensees take actions to reasonably assure that safety-related molded case circuit breakers can perform their safety functions. These actions consisted of two parts; (1) identify the safety-related breakers in the scope of the bulletin and trace them to their manufacturer, and (2) test any breakers that cannot be traced. We have taken action, as described in the Attachment, and have met the requirements of Bulletin 88-10.

Confirm that Action Items I through 7 of Bulletin 88-10 have been completed.

Response

1.

We have determined that 27 safety-related molded case circuit breakers were purchased between August I,1983 and August 1,1988. As of December 14, 1988.

there were 10 of these breakers remaining in the warehouse. Fifteen breakers have been installed; one in a safety-related application, fourteen in non-safety-related applications (see Table 1 ).

defective before installation and one was returned to the manufacturer, the 1

other was thrown away. A quick review of our procurement records shows that we have purchased an additional 48 safety-related molded case circuit breakers since December 1974, 22 of which were purchased since August 1978. A conversation with Paul Gill (NRR) established that a sample size of 27 breakers was adequate for response to the Bulletin.

We verified traceability for these circuit breakers by ensuring that Certificates of Conformance were available. Two of the breakers did not have Certificates of Conformance available. These have been removed from the warehouse stock, and are being retained for one year in accordance with the instructions provided by NUMARC in Reference (a). There are eight breakers remaining in the warehouse.

The following information is provided for the untraceable breakers:

Industrial Controls Division Model: 600 volt, HE frame, Catalog No. HE3-M040-000501 Procurement Chain: These breakers were purchased directly from Gould.

i However, the Certificates of Conformance are not available; our documentation consists of the shipping papers.

No installed breakers were untraceable.

Per the guidance given in the Reference (a), we have chosen not to test the two untraceable breakers. We have assumed that these breakers are failed for the purposes of complying with the bulletin. The breakers will be retained for one year in accordance with the NUMARC guidance.. _ _ _ _ _ _ _ - _ _ _ -

All molded case circuit breakers purchased between August 1,

1983 and August 1,1988, were examined as part of the initial sample in Item 1. All of the circuit breakers were traceable with the exception of the two identified in Item 1.

No action is required for this item, 6.

All documentation concerning the response to this bulletin will be transmitted to the plant history files.

We currently purchase all safety-related molded case circuit breakers directly from the manufacturer under a 10 CFR 50, Appendix B program. We have not purchased commercial quality breakers and upgraded them for safety-related use in the past, and have no plans to do so in the future. In fact, most safety-related circuit breakers are used in non-safety-related applications.

Verify that stored molded case circuit breakers meet the requirements of 10 CFR 50, Appendix B.

Response

The eight remaining safety-related breakers in the warehouse are traceable through Certificates of Conformance to the manufacturer. They were procured safety-related, not commercial quality. These breakers were procured in accordance with 10 CFR 50, Appendix B.

Identify number, manufacturer and model number of the untraceable circuit breakers.

No testing will be performed on the untraceable molded case circuit breakers.
