Licensee:

Vermont Yankee Nuclear Power Corporation (VYNPC) (EA 97-531)

Vermont Yankee Nuclear Power Station Docket No. 50-271 Subiect: PROPOSED IMPOSITION OF civil PENALTY - $55,000 This is to inform the Commission that a Notice of Violation and Proposed imposition of Civil Penalty in the amount of $55,000 will be issued on or about April 14,1998 to VYNPC. This action is based on a problem involving the Technical Specification (TS) limit for maximum torus operating temperature being inconsistent with the plant design basis.

The licensee failed to ensure that the design basis was correctly translated into specifications when the TS amendment request was submitted in 1982, failed to promptly

evaluate and correct the discrepancy between the Final Safety Analysis Report (FSAR) and the TS when it was identified in 1994, and failed to report operation of the plant in a condition outside of the design basis. The three violations are classified in the aggregate at Severity Level 111. 8ecause this was not the first escalated enforcement action within the past two years, the staff considered whether credit was warranted for identification and corrective action. Credit was not warranted for identification because tne failure to correct the discrepancy and the failure to report the condition were identified by the NRC.

Credit was warranted for corrective actions because VYNPC's corrective actions were considered prompt and comprehensive.

it should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice April 14,1998 Telephone Notification of Licensee April 14,1998 The State of Vermont and the Commonwealth of Massachusetts will be notified.

The licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalties may be remitted, mitigated, or imposed by Order.
