Dear Mr. Hayes:
This letter serves to verify the telephone conversation of September 6,1989 I
between you and Derek Widmayer of nor staff during which you discussed the Delaware Custom Materiel Topical Report entitled, " Test Results on Samples for 10CFR61 Qualification," dated February 25, 1988.
As discussed, the NRC has determined that the deficiencies that were identified in our June 20, 1989 letter to you are serious enough that we cannot commence a review of the Topical Report at this time. Therefore, we are returning the check you submitted in accordance with 10 CFR Part 170 when you delivered the Topical Reports to us. Except for one copy that will be retained for the file, we will destroy the copies of the Topical Reports that you submitted to us.
We will keep you informed of the development of a revision to the 1983 Waste Form Technical Position that will address Cement Stabilization.
Resources permitting, our current plans call for a draft of the revised report to be completed and available for guidance to vendors for development of Topical Reports by early 1990.
