ORDER DENYING REOUEST FOR HEARING On November 2,1988, the Director, Division of Reactor Projects-I/II, Office of Nuclear Reactor Regulation issued a NOTICE OF CONSIDERATION OF ISSUANCE OF AMENDMENT TO FACILITY OPERATING LICENSE AND PROPOSED NO SIGNIFICANT HAZARDS CONSIDERATION DETERMINATION AND OPPORTUNITY FOR HEARING (Notice) with respect to licenses held by Florida Power and Light Company, Docket Nos. 50-250 and 50-251, Turkey Point Plant, Units 3 and 4. The proposed amendments revised Sections 6.2 and 6.3 of the Administrative Controls Section of the Technical Specifications for the plant. 53 Fed. Reg. 44247-44251. The Notice specified that "any person whose interest may be affected by this proceeding and who wishes to participate as a party in the proceeding must file a written petition for leave to intervene" by December 2,1988. 53 Fed. Reg 44248. No requests for hearing or petitions for leave to intervene having been filed, the amendments were issued on March 27, 1989. 54 Fed. Reg.15843 ( April 19,1989).

e, On May 16, 1989 Thomas J. Saporito, Jr., submitted his " Request for Hearing and Petition for Leave to' Intervene" (arended May 18) with respect to these amendnents. Mr. Saporito's hearing request is more than five months out of time. No good cause is shown for such untimeliness. See 10 C.F.R. 6 2.714.

For this reason, pursuant to 10 C.F.R. 9 2.772(1), I hereby deny the request for hearing in this matter.
