ORDER This proceeding was initiated by the request of Rodger W. ' E111ngwood for a hearing on the NRC Staff's proposed denial of his application for a senior operator license for the Catawba Nuclear . Station. On April 18, 1989, B. Paul Cotter, Jr., Chief Administrative Judge of the Atomic Safety and Licensing Board Panel, designated Administrative Judge John H.

Frye, III, as the presiding officer in this proceeding. On April 27, 1989, Judge Frye. issued a Memorandum and Order in which he determined to apply the Commission's proposed rule, " Informal Hearing Procedures for Nuclear Reactor Operator Licensing Adjudications," 54 Fed. Reg.17961 (April 26,1989), to this proceeding. The proposed rule amends 10 C.F.R. Part 2, Subpart L (published as a final rule at 54 Fed. Reg. 8269 (February 28,1989)) to include operator license adjudications.
