Dear Mr. O'Sullivan:

I am responding to your mailgram of August 16, 1989 in which you expressed concern about the lack of action by the Nuclear Regulatory Commission (NRC) on your allegation of nuclear safety violations by Northeast Utilities Company at its Millstone Unit 2 nuclear power plant.

I am informed that Mr. Jacques P. Durr, the NRC Region I official who led the preliminary inquiry into this matter, provided those portions of the transcript of your meeting with the NRC staff relating to intimidation and harassment to the Region I '

Allegations Review Panel on July 7, 1989. The entire transcript was forwarded to Mr. Chester White of the Office of Investigations' (01's) Region I staff on July 27, 1989. I understand that Mr. White informed you of this referral during a telephone conversation on August 2, 1989. Subsequently, the Administrator of NRC's Region I Office reviewed the allegation and formally requested OI to conduct an' investigation.

OI is currently reviewing the Region I request and will notify you of its intended action on this matter within two weeks of its determination on whether to conduct a formal investigation. You should be aware, however, that the NRC has a number of investiga-tions in progress at any given point in time. These cases, incluoing those involving potential intimidation and harassment, are prioritized so that 01's available resources can be used to address first those issues with the greatest potential safety impact. This process will be followed in establishing a review plan for your concerns.

I want to assure you that the NRC takes very seriously its responsibility to protect the public health and safety and thoroughly reviews all allegations referred to us regarding the adequacy of licensee safety programs and potential wrongdoing.
