Dear Mr. Flater:

Thank you for your April 8,1998 letter regarding our recent annual meeting.

We appreciate the cooperation you and your staff extended to Messrs. Bolling and Lynch.

Although we recognize your desire for a longer meeting, our scheduling of the 1-day meeting recognizes the maturity of the Agreement State programs and the increased flexibility provided to Agreement States in running their programs, as recognized by the new Commission policies and the Integrated Materials Performance Evaluation Program (IMPEP). In addition, our budget only includes resources to conduct 1-day meetings and lengthening the meetings to 2-3 days would be difficult since no resources are available. Fina!ly, because of the Agreement State program maturity and flexibility reflected in NRC policies, we encourage Agreement States to conduct self-assessments, such as audits, to address issues, as they arise, to gauge the progress of actions taken from past reviews and to direct the future course of your program. For specific Agreement State issues that you identify related to regulations, inspection, and licensing, we will continue to address them by correspondence and meeting discussions, as necessary, through NRC's program of Agreernent State technical assistance.

We appreciate your support of the Agreement State program and look forward to working with you in the future. If this letter does not adequately address your concerns, I suggest we meet to discuss them further.

U.S. Nuclear Regulatory Conunission Washington, DC 20555 Dear Air. Bangart As you are aware, we had the pleasure of a one-day visit frotn Aisrs Lynch and Bolling of NRC on April 7,1998. It is our understanding that this type of visit is a part of the IAiPEP Program.

l in my opinion, this meetmg was of limited success. I, in no way, want you to get the idea that 1 l am being critical of what Aisrs Lynch and Bolling did during the visit. As usual, they were very l helpful with the limited time that they had to spend with us.

l To be truthful, a day spent determining what action we have taken to implement the reconunendations from our last IAiPEP review is not what we needed. We humans tend to slip into routines that may be right or wrong. An outside review by someone often helps to fine tune a program. I would like to suggest that serious consideration be given to allowing one or two NRC personnel to visit state programs for 2-3 days during the period of time between IAiPEP reviews. I feel that the 2-3 day oversight review is especially important when there are 1 3-4 years between the IAiPEP visits. This would give us concrete assistance to ensure that we are considering all issues in a good radiological health program.
