Dear Mr. Adams:

In December 1988, General Atomics (GA) completed its review and approval, per 10 CFR 50.59, of the installation of a new computerized console for GA's Mark I TRIGA reactor. GA did not intend to submit this "50.59 Safety Review" to NRC for approval because that would frustrate the whole rationale for having a regulation such as 10 CFR 50.59.

However, a courtesy copy of the completed 10 CFR 50.59 review was sent to NRC in January 1989 (see reference).

Subsequently, additional supplemental information was requested. This requested suppleniental information was sent to NRC by Mr. William Hyde.

When GA submitted thn courtesy copy of its completed 10 CFR 50.59 review, and supplemental information, it vac not considered necessary to request protection of the submitted information as proprietary. However, since then, GA bid on a contract to provide a computerized console for a U.S.

research reactor and lost the contract to a Canadian firm.

Consequently, GA is quite concerned about losing its competitive position. Accordingly, GA hereby requests that all information it has submitted relative to the subject 10 CFR 50.59 review be considered as GA proprietary informa-tion and afforded the requisite protection as provided under 10 CFR 2.790. The subject correspondence was not with regard to the issuance, denial, amendment, transfer, renewal, modification, suspension, revocation, or violation of a license, permit, or order, or regarding a rule making procedure.
