1 Dear Mr. Barnett:

This refers to the special, unann'ounced radiation safety inspection conducted

by Messrs. Lorenzo Wilborn and William L. Fisher of this office on November 15',

.

1988, and to the telephone enforcement conference conducted on February 16,'

1989. During the telephone enforcement conference, we discussed the findings ,

of.the above inspection, as described in the enclosed Enforcement Conference  !

Summary.

We have considered the information you provided during the enforcement

conference and have concluded that certain of.your activities were not

conducted in full compliance with NRC requirements. Specifically, the enclosed'

Notice of Violation states that your company, Barnett Industrial X-Ray,

performed unauthorized radiographic activities in Oklahoma.

Normally, you would be required to respond in writing about this-violation.

However, since you now are no longer doing business as-Barnett Industrial

X-Ray, no reply to this letter .is necessary.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations, a copy of this letter will be placed in

l the NRC's Public Document Room.

SUBJECT: ENFORCEMENT CONFERENCE TO DISCUSS APPARENT VIOLATION

OF NRC REQUIREMENT

On February 16, 1989, Mr. Robert L. Barnett discussed, by telephone with

Messrs. Hall, Fisher, Powers, Cain, and Sanborn of NRC Region IV, the results

of an NRC inspection conducted on November 15,.1988.

The NRC presented one apparent violation of NRC requirements - specifically,

that Barnett Industrial X-Ray had worked in Oklahoma without a license.

Mr. Barnett stated his belief that NRC had authorized him to move his trailer

(i.e. , place of business) from El Dorado, Kansas, to Oklahoma. The NRC staff

replied that it was not aware of such authorization. The NRC staff discussed

the enforcement policy and stated that a decision would be made as to the

appropriate enforcement action and that the licensee would be notified.
