SUMMARY

OF APRIL 17,1998, MEETING WITH DEPARTMENT OF ENERG'.' ON STATUS OF THE FOREIGN RESEARCH REACTOR SPENT NUCLEAR FUEL PROGRAM On April 17,1998, representatives of the Nuclear Regulatory Commission (NRC) and the Department of Energy (DOE) met to discuss the status of the foreign research reactor spent nuclear fuel (FRR SNF) program and DOE's scheduled activities over the next 2 years.

Representatives from NAC Intemational (NAC) and Edlow International (Edlow), DOE contractors for the FRR SNF program, provided program perspectives and project status, future I

transportation cask utilization options, and an overview of the certification /re-validation status.

Also discussed was NRC's activities in support of the program and opportunities to improve communications between the organizations. Attachment 1 is the meeting agenda, is the attendance list, and Attachment 3 includes the meeting handouts., provided subsequent to the meeting, incluoes a DOE summary of some of the information discussed. This meeting was noticed on April 10,1998.

The staff's opening remarks focused on the recent lessons leamed in supporting the FRR SNF program and characterized these events as highly disruptive to the Spent Fuel Project Office

/

(SFPO) mission. For example, frequent 10 CFR 73.37(f)(2)(iii) exemptions are necessary to protect shipment scheduling information. Furthermore, requests for re-validation of foreign 1l certificates and Certificate of Compliance (CoC) amendments frequently require short tum-around reviews resulting in a detrimental effect on other SFPO casework. The staff dso Jn expressed NRC's desire to work effectively with DOE to support the FRR SNF program, but emphasized the need to enhance planning and communications in order to justify dedicating SFPO resources.

Mr. David G. Huizenga, DOE's Acting Deputy Assistant Secretary for Nuclear Material and Facility Stabilization, commented on the program's origin and 10-year acceptance policy and the public's support of non-proliferation aspects. Mr. Huizenga noted that DOE (1) had not anticipated the degree of SFPO work disruption, (2) does not self-certify the transportation casks used, and (3) does not have designated personnel to perform such self-certifications. Mr.

Huizenga indicated his desire for NRC and DOE to continue working together to improve coordination and communication with regard to the program's plannin and scheduling.

The remainder of the meeting consisted of a series of presentations by DOE, Edlow, NAC, and NRC representatives. The major topics discussed were-l

_ Status of the FRR SNF Prem.in and Sch=dula - DOE-Savannah River Site repie.ent iives provided a schedule for shipments over the next 2 years and a graphical representation of the annual number of spent fuel assemblies scheduled for receipt through the year 2009. Discussions included the domestic-and foreign-owned casks which are being considered for use in the program, along with the certification status.

Schedular Information for Calendar Year 1998 Activities - DOE provided schedular I

information on possible requests for cask re certifications /re-validations and route approvals during the remainder of the year.

i Edlow Intemational FRR SNF Pro!=d St=Na - Edlow provided schedular information on future shipments and the status of particular cask certifications.

NAC International FRR SNF Project St=N= - NAC provided its perspective on the program, highlighting aspects of the broad and uncertain work scope which lead to difficulties in providing bounding applications to the NRC well in advance of the planned i

shipments. NAC also described the foreseeable amendment requests for the NAC legal l

weight truck (LWT) cask.

SFPO Storace and Transocit. tion Cask Workload - SFPO charactenzed the l

prioritization and the current workload and responsibilities of the technical review and licensing sections. Also emphasized was the importance of good communications, budgeting and priontization, and minimizing the number of expedited reviews requested.

Oooortunities for Imoroved Communi-Men - DOE and SFPO discussed ways to improve communications and processes for ensuring that information is provided in a j

more timely manner.

Periodic Proaram Review - DOE agreed to provide NRC management with annual program updates and the technical staff with quarterly updates.

Information on the TRIGA 28 Basket - DOE and NAC agreed to provide SFPO with information on the schedule for use of the TRIGA 28 basket.

DOE Soent Nuclear Fuel Acceptance Criteria for Transportation - DOE provided general information on its requirements for the inspection and acceptance of spent fuel in preparation for transportation. DOE will provide its spent nuclear fuel transportation acceptance criteria to NRC.

l Hiah Visibility Shioments - DOE agreed to advise the NRC of potentially high visibility shipments conducted under the FRR SNF program.

l Status of Departinent of Transportation Reviews - NRC agreed to discuss with DOE the status of pending certification requests for packages to support the FRR SNF program.

Commercial Cask Certifications - NRC agreed to advise DOE of any other cask certification requests which could also assist the FRR SNF program.

  • Research reactor spent nuclear fuel containing uranium enriched in ths U.S. will be accepted from 41 countries and managed in the United States.

- About 20 metric tons (5 tons of HEU)

- includes aluminum-based and TRIGA research reactor spent fuel and target material

  • 10-year acceptance policy (May 13,1996 to May 13, 2006)

- Provides time for reactor operators to develop own solutions

- Fuel irradiated during the 10-year window will be accepted over a 13-year period
