. Gentlemen:.
Thank you for your letters of May 22 and June 19, 1989, in response to our
. letter dated March 31,'1989.- We have reviewed your reply to our Notice of; Nonconformance and have' a concern with your review into the design classifi-
. cation' associated with the electrical interface material referenced on the 35 purchase orders (P0s) placed with Gismo Company. The concern stems from the
' fact that these P0s were processed as " safety-related" and as such the associated material would have-been available for use-in safety-related-
' applications at Waterford 3. Therefore, your review should focus on the
' application in which this material was installed,'rather than the intent of-Ebasco Specification LOU 1564.249R referenced ~1n the P0s.
Should your review determine that the material was actually classified as-non-safety /non-seismic, NRC.would' expect Ebasco to provide assurance ~that- this material was not inadvertently used in' safety-related applications' due to its classification. Specifically, please identify the applications in which Ebasco used the material purchased under Ebasco Specification LOU 1564.249A. Regarding the Notice of Violation concerning Ebasco's placement of two P0s for safety-related electrical material without imposing the requirements of 10 CFR Part 21 on the supplier, we offer the following:
- 1. A review of both P0s identified a classification of " safety-related." -{
- 2. Ebasco imposed on the seller that his facility be available for NRC inspection.
- 3. Ebasco required that the seller furnish the material in accor-dance with the manufacturer's 10 CFR Part 50, Appendix B program, as. audited and approved by Ebasco.
- 4. Ebasco required packaging requirements as set forth in ANSI N45.2.2 be met. )]
