Dear-Mr. Parmar:

Thank you for your letter dated June 29, 1989 notifying the. Nuclear. Regulatory

-Commission (NRC) of the problem concerning replacement printed circuit boards utilized in C&D Charter Power Systems, Inc. (CPSI) model ARR Series battery

-chargers.

The NRC acknowledges your request for us to make a deportability evaluation, however, paragraph 21.21(a)(1) to 10 CFR Part 21' requires the vendor to make such evaluation, or, if not able to do so, to notify their customers so that they Lcan make the. deportability evaluation. For example', Philadelphia Electric:

Company (PECo) made a deportability evaluation cf the problem with Model ARR130HK300 battery charger and submitted a.Part 21 report to the NRC. However, this does not mean that all utilities will make the same determination for their applications of this equipment.

Therefore, two options are available under 10 CFR Part 21 deportability require-nents. The.first option is if~C&D CPSI has' performed an evaluation and determines that the problem relates to a potential substantial .safecy hazard or if the basic component contains a defect, then a report needs to be submitted to the NRC in accordance with paragraph 21.21(b)(2) to 10 CFR Part 21 with a list of-customers. Also provide your customers with corrective actions which need to -

be taken. The second option is that if C&D is aware of the problem and cannot determine that it is reportable, then they should notify their' customers so that they can make the deportability. evaluation.' - The customers do not have to provide a' notification to the NRC if the individual has actual knowledge that:

the NRC has been adequately informed in accordance with paragraph 21.21(b)(1) to 10 CF.R Part 21.

It is requested that you provide the NRC copies of communications to your custoners for their. deportability evaluation and your notification of corrective  ;

action, depending on what option C&D CPSI. chooses. I If there are any questions regarding the above please contact Mr. R. N. Moist at.
