Dear Mr. Russell:
As the Commission knows, on February 28 Long Island Lighting Company entered into an executory agreement with New York State, pursuant to which LILCO would, among other things, not operate the Shoreham Nuclear Power Station if the agreement became effective. The final precondition to the agreement's effectiveness.was shareholder approval, which was granted at the Company's annual meeting on June 28.
This agreement is now fully effective and binding on LILCO.
Accordingly, LILCO is contractually prohibited from operating the Shoreham Nuclear Power Station and intends to abide by this obligation.
LILCO also intends to abide in all respects by the terms of its operating license, issued by the NRC on April 21, 1989, while keeping the plant in a shutdown condition until such time as it is transferred to an agency of New York State pursuant to the February 28 agreement. As was stated to Region I staff on June 30, LILCO intende to co=mence defueling the reactor shortly, in accordance with normal procedures, and expects to complete defueling by about August 15.
Between now and August 15 the Company intends to reduce staffing levels as discussed on June 30, consistent with our obligations under the operat1ng license. Upon completion of defueling LILCO will implement various other steps consistent with maintaining the plant in a safe cold shutdown condition. LILCO will keep the Region apprised of these steps and will notify the Region sufficiently in advance of any change in the plant's status, as described in this letter, to enable it to perform any inspections or other inquiries it deems necessary.
