ADVICE TO THE LICENSYNG BOARD REGARDING THE COMMONWEALTH 00 MASSACHUSETTS POSITION REGARDING DRY CASK STORAGE Pursuant to this Board's orders, the Attorney General of the Commonwealth of Massachusetts (" Mass AG') states as follows:

1. The Mass AG joins in the arguments set forth in NECNP's Brief in Summary of Relevant Facts and Arguments on Which NECNP Intends to Rely At Oral Argument On Environmental Contention 3 dated $ay23, 1989. Further, the Mass AG supports the testimony offered by Dr. Gordon Thompson.
2. The Mass AG states that in the event that as a result of the NRC's decision in this docket Vermont Yankee does make use of such dry cask storage to store radioactive material, he ljg5300071 890523 O DOCK 0500o27, PDR g6

l Will not in any ratemaking proceeding, concerning Vermont Yankee's rates, challenge the decision to employ dry cask storage. The Massachusetts Attorney General reserves the right to challenge the reasonableness or appropriateness of any particular costs or expenses incurred by Vermont Yankee in its dry cask storage endeavors.
