ORDER on May 16, 1989, the Massachuse; 3 Attorney General filed.a notice of appeal from certain aspects of the Licensing Board's December 30, 1988 partial initial decision that the Board assertedly made final by a May 5, 1989 memorandum and order.
In a memorandum accompanying his notice of appeal, the Attorney General states that his notice is a protective one intended to preserve his appellate rights.
He opines, however, that the Licensing l
l Board's order is not now appealable.
j We would like the views of the NRC staff and the applicants on the question of whether the Attorney General's notice of appeal is premature as he suggests.
