Routine Inspection No. 99990001/89-004 On January 19, 1989, Richard B. Provencher of this office conducted a routine safety inspection at Tiernan Hall, 161 Warren Street, Newark, New Jersey of activities authorized by the above listed NRC general license. The inspection ,
was an cramination of your licensed activities as they relate to radiation safety and to compliance with the Commission's regulations and the license j conditions. The inspection consisted of observations by the inspector, interviews wit h personnel, and a selective examination of representative records. The findings of the inspection were discussed with Dr. B. KebbeLus at the conclusion of the inspection Cased on the results of this inspection, it appears that your activities were (
1 not conducted in full compliance with NRC requirements. A Notice of Violation l is enciesed as Appendix A cnd categorizes cach violation by severity level in j accordance with the " General Statement of Policy and Procedure for NRC Enforce- !
ment Actions," 10 CFR Part 2, Appendix C (Enforcement Policy). You are required to respond to this letter and in preparing your response, you should follow the instructions in Appendix A.

NOTICE OF VIOLATION i
j New Jersey Institute of Technology Docket No. 99990001 l Newark, New Jersey 07102 General License As a result of the inspection conducted on January 19, 1989, and in accordance
-with the " General Statement of Policy and Procedure for NRC Enforcement Actions,"
10 CFR Pait 2, Appendix C (Enforcement Policy) (1988), the following violation- i was identified: I 10 CFR 31.5(c)(2) requires that generally licensed devices be tested for l leakage of radioactive material at a frequency specified by the manufacturer. j l Varian Instrument Division has established a 3 year leak test frequency '
for detector cell Model No. 02-001972-00.
Contrary to the above, as of January' 19, 1987, the licensee's 3 Varian gas chromatography (Model No. 02-001972-00) containing 8 millicuries of Nickel-63 each, and used weekly by students and faculty, has not been tested for leakage l or contamination since April 1985, an interval exceeding 3 years. ;
This is a Severity Level IV violation. (Supplement VI)
Pursuant to the provisions of 10 CFR 2.201, New Jersey Institute of Technology is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have-been taken and the results ,
achieved; (2) corrective steps which will be talen to avoid further violations; )
and (3) the date when full compliance will be achieved. Where gcod cause is i shown, consideration will be given to extending this response time. J
