SUBJECT:

LONG. TERM CARE RULEMAKING FOR URANIUM MILL TAILINGS SITES.

In a March 27, 1989 memorandum from J. Greeves to G. Arlotto, we indicated l

that we were still in the process of resolving several issues relating to the rulemaking action. These. issues have now been resolved. However, as a result of the proposed final EPA standards.(40 CFR Part 192, Subparts A, B, and C),

our original approach of issuing a general license for long term care may no longer be feasible. We have discussed the implications of these standards with the Office of the General Counsel (0GC) and with your staff. We are in the t

i process of conveying our comments on and concerns with the standards to the Office of Management and Budget. As we progress to resolution of these issues, we shall keep you informed. However, we recommend that further significant effort not be undertaken until the EPA standards are finally promulgated and

-until we have collectively had an opportunity to assess the attendant l

implications. We understand that you needed our formal notification, in order to revise your schedule with the Office of the Executive Director for l

Operations. We are uncertain, at this time, on the schedule for publication cf final standards. We have, however, recommended that OMB establish a milestone for EPA's revision of the standards to help ensure a reasonable and i

timely schedule for their final promulgation.

However, as a result of the proposed final EPA regulations (40 CFR Part 192, Subparts A, B, and C),

our original approach of issuing a general license for long-term care may no longer be feasible. We have discussed the implications of these standards with the Office of the General Counsel (0GC), as well as with your staff. We are in the process of conveying our comments on and concerns with the standards to the Office of Managementsand Budget. As we progress to resolution of our issues with these EPA standards, we shall keep you informed.

It may now be appropriate to consider revising the present version of the long-term care rule to adopt the approach of specific licensing under 10 CFR Part 40. This much we can proceed with. However, we recommend that further effort beyond this change of approach not be undertaken untilsthe EPA regulations are finally promulgated and until we have had an opportunity'to assess the attendant implications. We understand that you needed our formal notification, in order to revise your schedule with the Office of the Executive Director for Operations.
