Dear Senator Bentsen:
This is in answer to your letter of November 29, 1988, which enclosed a letter you had received from Mr. and Mrs. Walter L. Manka of Waco, Texas regarding the license renewal process for the Panr.a flaria Uranium Project in Karnes County, Texas.
Under Section 274 of the Atomic Energy Act as amended, the State of Texas has negotiated an Agreement State Status with the U.S. Nuclear Regulatory Commission.
This agreement authorizes the State of Texas to exercise its own regulatory authority over uranium milling and tailings disposal activities within Texas.
The Texas Department of Health, in accordance with State requirements, convened a hearing on July 19, 1988, regarding the proposed license renewal for the Panna Maria site. The hearing was recessed the next day for the purpose of establishing party status for various interested groups. On October 7, 1988, the Hearing Examiner for the Texas Department of Health informed Mr. and Mrs. Manka that they were made a party to the hearing, in addition to several other groups. As yet, no date has been determined for reconvening the hearing for this proposed license renewal action.
Detailed information regarding this licensing action is available in a publication (TBRC EA-16) from the Bureau of Radiation Control, Texas Department of Health, which is entitled, " Environmental Assessment, Safety Evaluation Report, and Proposed License Conditions Related to the Renewal of License No. 9-2402, Chevron Resources Company, Panna Maria Uranium Project, Karnes County, Texas."
