Dear Mr. Chairman:

In response to your request dated June 13, 1988, I am enclosing the documents concerning the December 31, 1986 incident at Davis Besse (Question 1) and the rulemaking on Fitness for Duty (Question 3). The documentation requested on the NRC investi-gation of the December 31, 1986 incident at Davis-Besse and the utility's investigation of that incident (Question 2) is q presently being used by the Office of Investigations (01) to i prepare their final report. OI anticipates the report will be completed by mid-July. As discussed with your staff, a copy will be provided to the Subcommittee as soon as it is completed and will list and reference the documents requested.

S he enclosed documents include internal staff memoranda, predecisional drafts and other sensitive documents that are protected from public disclosure under the Freedom of Information Act. Therefore, we request that these documents not be made generally available to the public. Should you or your staff have any questions regarding the disclosure status of particular documents, please contact our Congressional Affairs staff.
