HEPORT TO THE COMMISSLQ]i In a February 3, 1989 Memorandum, the Commission directed the Licensing Board to inform the Commission if a September 30, 1989 target date for the final initial decision cannot be achieved.

In an oral report through the 4

Office of General Counsel in May 1989, we informed the Commission that the September 30 date r.:amtot be met and predicted a 30 to 60-day slfy for the final initial decision.

We promised a further report upon the closing of the evidentiary record.

L t" The evidentiary record closed on June 30, 1989.

A schedule for the filing of proposed findings of fact and conclusions of law has been set ending with reply proposed findings by Applicants due on August 31.

Our target date for the initial decision is November 30, 1989.

The hearing on the Seabrook Plan for the Massachusetts Communities and the June 1988 FEMA graded exLrcise occupied 57 hearing days -- about the same as for the hearing on the New Hampshire Radiological Emergency Response Plan, but the evidentiary record of'the Massachusetts / FEMA-excrcise hearing is somewhat larger than the record of the New Hampshire hearing.

The Board has provided for a sequence and a format for the filing of proposed findings intended to identify better the areas of dispute, which, we expect, will shorten decision-writing time.

While it is difficult to quantify the factors affecting a target date for the initial decision, the Board believes that the November 30, 1989 target date~is reasonable and can be achieved.

The Attorney General of Massachusetts has informed the Board and parties that he intends to file contentions on a scramming incident during low power testing at Seabrook and on the onsite emergency response exercise scheduled for 9
