PROPOSED IMPOSITION OF CIVIL PENALTY - $2,500 This is to inform the Commission that a Notice of Violation and Proposed ,
Imposition of Civil Penalty in the amount of Two Thousand Five Hundred Dollars '
($2,500) will be issued on or about March 22, 1989 to Defense Nuclear Agency, Bethesda, Maryland. This action is based on a number of violations that include (1) failure to perform written safety evaluations, (2) procedure adherence problems, (3) failure to ensure all operators satisfactorily completed the requalification training program, and (4) discrimination, in violation of 10 CFR 50.7, against an employee who raised safety concerns. No escalation or mitigation was deemed appropriate because though the violations were identified in a followup NRC investigation, the licensee has instituted extensive long term corrective actions.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice March 22, 1989 Telephone Notification of Licensee March 22, 1989 The State of Maryland will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
