Dear Mr. Chilk:

These comments are submitted on behalf of The Toledo Edison Company, Davis-Besse Nuclear Power Station in response to the request of the Nuclear Regulatory Commission (NRC) for comments on Advance Notice of Proposed Rulemaking (ANPR)

-regarding nuclear procurement issues (54 FR 9229).

Toledo Edison strongly supports the Nuclear Management and Resources Council (NUMARC) position noted in the June 26, 1989, submittal to the (NRC), that issuance of a rule or modification to existing regulations would not provide the most effective course of action at this time.

However, there is currently an ongoing industry activity to evaluate and improve utility procurement practices.

The NUMARC Nuclear Plant Equipment Procurement (NPEP) Vorking Group was created in September 1988 to develor long term resolution to address industry and NRC concerns related to the procurement process. The existing regulation, codes, and standards used in concert with the ongoing industry procurement improvement activities and initiatives, provide a comprehensive and timely mechanism to h

address concerns about fraudulent products in an overall context.
