IMPOSITION OF CIVIL' PENALTY - $300,000 By EN 88-31 dated April 28, 1988 the Commission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in i the amount of Three Hundred Thousand Dollars ($300,000) to Baltimore Gas &

Electric Company. This action was based on violations involving equipment qualification requirements of 10 CFR 50.49.

The licensee responded to the Notice in letters dated July 12 and 18, 1988.

After careful consideration of the licensee's response, the staff has concluded that the violation did occur as set forth in the Notice of Violation ai.u Proposed Imposition of Civil Penalty.

Accordingly, an Order Imposing Civil Penalty in the amount of Three Hundred Thousand Dollars has been issued today. Under the terms of the Order, the l licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
