REVIEW 0F PART 50 FINAL RULE - LICENSEE ANN 0UNCEMENT OF INSPECTORS The Division of Freedom of Information and Publications Services has reviewed the subject rule and accompanying documents. Enclosed is a marked copy of the rule and accompanying documents that contains coments that will require changes before the rulemaking package is sent to the EDO for signature and publication.

In your. note attached to the rulemaking package, you questioned the applicability

-of a Regulatory An'alysis and Congressional letters as enclosures to this rulemaking' package.

Generally, a Regulatory Analysis is required to accompany each proposed or final rule; however, since the purpose of this rule is to clarify existing requirements and does not add any new requirements, we have checked and the Regulatory Analysis. statement included in this rule is acceptable.

Congressional letters are necessary to keep the Congress fully and currently infortued of significant rulemaking issues within the NRC. The office resransible for preparing the rule makes the decision on whether or not Congressional comittees should be notified of a rulemaking action.

If NRR decides to prepare Congressional letters, we have enclosed a sample copy of a letter and a list of addresses for the Congressional Oversight Comittees. Note, however, that nearly all final rules approved by the Comission and many significant rules signed by the ED0 have been provided to Congressional committees at the time of the rule's publication in the Federal Register.

In response to your concern regarding what should be ph - 4 under the "Recomended" heading in the Comission paper, you shoC0 aate exactly what you recomend, i.e., whether the Commission should approve or disapprove the final rule, information on whpther Congressional Comittees and licensees will be notified of the issuance of the rule, and any other pertinent information that you believe is necessary. We have drafted text for your use at page 2 of the Commission paper. As for the " Scheduling" heading, you should note if any deadlines are to be met and whether this rule should be discussed at an open or closed session. However, if this type of information does not apply to'this rule, omit this heading altogether, j
