SUBJECT:
MANUAL CHAPTER, STAFFING PLAN, AND BUDGET FOR THE OFFICE OF THE LICENSING SUPPORT SYSTEM ADMINISTRATOR In response to your July 18, 1989 memorandum, the Commission has approved the attached copy of the Manual Chapter and agrees with the proposed changes to the Staffing Plan.
The Commission has taken no further action on the budget proposal, which had previously been addressed in the Commission's consideration of the'Five Year Plan and the budget, other than to direct the staff to advise OMB that DOE should budget for the.LSSA and operations and maintenance of.the LSS.
(The proposed letter to OMB transmitting the FY 1991 budget submittal, which includes language stating that DOE should fund the LSSA and LSS operations and maintenance, is under review by the Commission).

0100 Organization LSS CHAPTER NRC-01XX ORGANIZATION AND FUNCTIONS OFFICE OF LICENSING SUPPORT SYSTEM (LSS) ADMINISTRATOR 01XX-01 SUPERVISION The' Office of the LSS Administrator is headed by the LSS Administrator.
With the exception of the LSS Administrator's certification of DOE -
compliance under 10 CFR 2.1003(h)(1), the LSS' Administrator reports to-
- the Chaiman for day-to-day management supervision and to the Commission for policy direction.
01XX-02 FUNCTIONS The Office is. responsible for the following:

ensuring that the LSS. meets the requirements in-10 CFR Part 2, Subpart J, related to the availability and use of the LSS in the Comission's high'-level waste licensing proceeding; MG advisingDOEonthedesign, development,Mtestingfandapprovingany b.

1 Specifically, the Office--
021 Ensures that. documentary material of each LSS participant, including the NRC, is properly received, entered into the LSS in searchable full text and image, as appropriate, and maintained; 022 With the advice of the LSS Advisory Review Panel, establishes the necessary protocols for headers, document submission, and access to the LSS; 023 Revises, as necessary, the headers for material entered into the LSS, including headers for documentary material to which a claim of privilege has been asserted under 10 CFR 2.1006; 024 Ensures that material escribed in 10 CFR 2.1005 is properly excluded from the LS ;
025 Establishes and applies an effective quality assurance program prior to and during the operation of the LSS; 026 Establishes the necessary security requirements to protect the LSS data base; 027 Provides access to the LSS to LSS participants, and the public as appropriate, as specified in 10 CFR Part 2, Subpart J; 028 Provides training access the LS Q, and other assistance to LSS users on how t 029 Provides for the electronic submission of all filings by LSS participants, and adjudicatory issuances, during the HLW proceeding in accordance with 10 CFR Part 2, Subpart Q 0210 Provides for the use of the LSS ouring the hearing by the Hearing Licensing Board and the parties to the HLW proceeding; 0211 Evaluates DOE compliance with the LSS rules in accordance with i

01XX-3 DELEGATION OF AUTHORITY TO THE LSS ADMINISTRATOR The LSS Administrator is authorized and directed to:
031 Take such action as is necessary to carry out the functions assigned by this chapter or other official directives or communications, subject to the limitations prescribed therein.
(Delegations of authority for specific actions and applicable limitations are contained in manual chapters or other directives coveringspecificsubjects.)
032 Supervise, direct, coordinate, and approve the activities perfomed within the Office.
033 Develop policy options for Commission consideration on matters within delegated authority.
034 Consult with DOE on Lb5 desiga, siting, development, procurement, and other agreements ano participate on DOE Source Evaluation Panels. Assure that user requirements are properly designed into the LSS and that the LSS is properly designed and developed prior to NRC acceptance from DOE.
035 Select and oversee contractor (s) to operate and maintain the LSS and impicment 6 comprehensive quality assurance program.
In doing so assure adequace public access to contents of the LSS; adequate protection of classified and privileged documents; LSS database completeness, availability, and integrity; establishment of a special file within the LSS for the official adjudicatory record materials for the-licensing proceeding; the LSS incorporates all electronic mail filings; establishment of a training program for LSS users; and, provision of assistance to LSS users in their search of LSS documents.
036 With Commission approval, appoint members to the LSS Advisory Review Panel (LSSARP) and implement the consensus advice of the LSSARP, consistent with Commission guidance, e-037 IssueAevaluation report every six months on DOE's compliance with the LSS rule and recommend actions that need to be taken by DOE to achieve compliance. Certify, if appropriate, DOE compliance with the LSS rule in accordance with 10 CFR 2.1003(h).
