SUBJECT:
LETTER FROM TENNESSEE PROHIBITING WASTE PROCESSORS FROM HANDLING WASTE FROM STATES NOT IN COMPLIANCE WITH LLRWPAA-The LLWM staff has reviewed the subject letter and has several concerns.about the action taken by Tennessee regarding the handling of low-level radioactive waste.
The action taken by the Tennessee Department of Health and Environment, as documented in the subject letter, is not " Pursuant to national- )olicy regarding low-level radioactive waste..." as stated in the first paragrap1. heither the 1980 nor the 1985 low-level waste legislation contain explicit references to interstate transport ~of low-level waste for storage or treatment.
If anything, the action appears to be contrary to the intent of national
' low-level waste legislation.
In addition, the concept of using regulatory.
mechanisms to affect compliance with the LLRWPAA is viewed as an inappropriate use of the authority granted to the state pursuant to the Atomic Energy Act.
We can understand Tennessee's concern about becoming an inadvertent storage location for low-level waste not generated within the State. However, it would seem that removing the treatment option has potential health and safety implications, particularly in a national environment in which waste management options, in. general, will be limited.
l Finally, Tennessee's action appears to be an unwarranted, if not illegal, restriction of interstate commerce. Unless this policy is adopted by all states, Tennessee's action seems to place an unfair restriction on the ability
.of private radioactive waste management companies in Tennessee to effectively compete with companies located in other states.
The LLW Torum has planneo a seminar on Inter-regional Low-Level Radioactive Waste Treatment and Processing for its summer meeting..One objective of the semin'ar is to develop policy options in this area for implementation by the 1

states and compacts. Following the seminar, we should consider the action taken by Tennessee and policy options being considered by all states in the context of need for t.ny NRC action, such as a formal response to the State of Tennessee.
