Dear Mr. Matthews:
l By your letter of June 1,1989, DOE transmitted for NRC review and concurrence Revision C to the Green River, Utah Remedial Action Inspection Plan (RAIP).
As requested in your letter, the RAIP was reviewed by the NRC staff and l
a response to DOE was sent on June 22, 1989. However, your transmittal letter makes two points that should be clarified. First you refer to " extensive delay" and second you mention tacit approval.
Regarding the first item, DOE's decision to revise the Green River design and RAIP caused the delay referred to in your letter. Upon recespt of the draft final RAP which was submitted by D6t! on February 7,1989, the RAP and RAIP were reviewed. Based on that review NRC stated that the RAIP needed to be revised based on DOE's fRAP revisions. This revision was submitted on t
June 1,1989 and reviewed within the 21 day review time as agreed to in the MOU.
Re<garding the second item, please be aware that NRC's approval or concurrence can only be granted in writing by authorized representatives of the NRC. DOE should not assume tacit approval prior to receiving NRC's response.
