FOR REVIEW AND APPROVAL OF SPEECHES, PAPERS, AND L
JOURNAL ARTICLES BY NRR STAFF OR CONTRACTORS PURPOSE This office letter, which provides the procedures for review and approval of speeches, papers, and journal articles of NRR staff or contractors, has been revised pursuant to the ED0's memorandum of May 6, 1988, " Review of Speeches, PapersandJournalArticles(NRCManualChapter[MC]3205)." The revision to MC 3205 of May 24, 1988 changes the process-for review and approval of speeches, papers, and journal articles of NRC staff members, adds a respon-sibility statement for the Deputy Executive Director for Regional Operations *,
and places responsibility for reviewing and approving such speeches and papers of NRC staff members at the office director or associate director level.
This office letter also places responsibility for NRR review and approval of the technical and regulatory content of certain speeches, papers, and journal articles proposed by NRR contractors at the level of the assistant director or the next level above branch chief (depending on how the division is configured) for all new contracts. This upgrading of review practice is in full agreement with MC 3206, "NRC Contractor Unclassified Papers, Journal Articles and Press er Other Media Releases on Regulatory and Technical Subjects."
Although this office letter implements certain administrative steps not discussed in MCs 3205 and 3206, it does_not supersede these manual chapters nor does it repeat all information contained therein. Therefore, the prospective author, s)eaker, or management reviewer must refer to these documents in addition to t11s office letter.

Such presentations are a means of explaining the technical bases underlying regulatory requirements, policies, and guidelines, and their implementation.
The specific objectives of these procedures are (1) to ensure that NRR staff and contractor personnel present appropriate regulatory and technical information in speeches and papers at meetings and conferences and in publications in professional journals (2) to provide for review and approval of papers by NRR staff and contractors so that the appropriate regulatory and technical positions are presented by HRC representatives (3) to delineate responsibility within NRR for the review and approval of publications and other presentations RESPONSIBILITIES AND AUTHORITIES Director, NRR The Director ensures that the objectives of this Office Letter are achieved.
The Director reviews papers and publications deemed to contain new policy issues as determined by the Associate Directors or Staff Director. The Director may be assisted by the Deputy Director in this function.
Associate Directors and Staff Director, NRR (1) Review and authorize a paper or speech by an NRR author. This is followed by authorization for presentation and/or publication by the signature of the author's immediate supervisor on NRC Form 426 " Publications Release for Unclassified NRC Staff Reports."
In accordance with MC 3205, authorization for presentation or publication must be given before the presentation. The review and approval process shall be scheduled to provide approval not more than 15 days after the author's request for authorization.
(2)
In the case of speeches, papers, and journal articles by NRR staff in which new and unresolved policy issues are discussed, the following apply.
(a)
If the functions of other offices are involved, the Associate Director or Staff Director is responsible for obtaining reviews by the directors, or other appropriate management representatives, of other applicable organizations.
(b) The Director of HRR will provide for review by the Executive Director forOperations(ED0).

If the policy issues discussed are published NRC policy, review and authorization by an Associate Director or the Staff Director, pMAS, is necessary and sufficient.

(4) The Staff Director of NRR informs the ED0 of an accepted staff speaking engagement (see MC 3205-035h) via the meeting notice section of the Weekly Information Report of the Office of the EDO.
Notification of the date and other factual information (see Enclosure) of an accepted staff speaking engagement will be provided promptly to the Staff Director by the Associate Director authorizing the presentation via the NRR Weekly Highlights.
Division Director, NRR (1) The appropriate division director approves the topic, NRR author, travel expenditure *, and abstract or summary before acceptance of an invitation to submit or present an invited paper or before submittal of a contributed paper.
(2) The appropriate division director ensures that the author obtains the appropriate reviews, coments, and concurrences of other NRR divisions and other NRC offices.
Assistant Division Director (or next level above Branch Chief), NRR Review and approval of the technical and regulatory content of the external communications proposed by an NRR contractor shall be performed in accordance with the provisions of MC 3206 by the appropriate assistant division director or the next highest management level above branch chief for divisions that do not have assistant directors. The reviewer shall comunicate approval, disapproval, or any required modifications of the paper or speech to the Chief, Technical Assistann "anagement Section, who will implement contractual procedures in accordt e with MC 3206.
Lead Engineer, NRR The NRR lead engineer responsible for the technical review of the technical assistance contract shall provide an expeditious preliminary review of the technical and regulatory content of any contractor speeches, papers or journal articles based on the contract work. The lead engineer's primary role is to identify any problematic treatments of technical and regulatory issues that will aid the assistant director (or next highest management level above branch chief) in his or her review and approval responsibility defined above.
Technical Assistance Project Manager, NRR The technical assistance project manager will coordinate the review and approval process for contractor speeches, papers or journal articles based on information developed as a result of NRR-supported technical assistance.
- For papers that require foreign travel, NRR Office Letter No. 1400, " Foreign Travel Approval Procedures," should be followed regarding travel approval.

BASIC REQUIREMENTS Review and Approval of External Communications of the NRR Staff When an NRR staff member receives an invitation to author a journal article or l
to present a paper at a professional society meeting or a technical conference, he or she will obtain approval to accept the invitation through his or her management organization, up to and including the division director. This approval request will normally* involve (1) preparation of a written outline, abstract, or summary of the proposed paper; (2) an estimate of travel expenses, page charges, and any other costs; (3) identification of any conflicts between the author's views and documented NRC policies or positions; and (4) a discussion or statement on whether the paper will involve a new and unresolved policy issue.
If a new and unresolved policy issue is involved, the division director will have the appropriate associate director review the sumary or abstract of the paper before the division director approves acceptance of an invitation. At least I week should be allowed for this review.
The procedures for contributed papers for journals or meetings are similar, except that acceptance of an invitation is not involved. The division director should give approval before the author submits a summary or abstract to the program committee for such meetings.
Following approval by the division director, the author should prepare the final paper on a schedule that meets the required submittal dates and internal review time. The author must coordinate with other NRR divisions and other NRC offices, as appropriate (see NRC MC 3205).
The author must prepare an NRC Form 426 to submit with the final paper for the office director's or associate director's approval.
If any policy issues are discussed that go beyond published NRC policy, involving new and unresolved policy implications, the office director will provide for review by the EDO.
If the issues are of agency-wide significance, the EDO will transmit the speech, paper, or journal article to the Commission for review.
In cases in which disagreements between an author's views and NRC policy cannot be resolved, NRC HC 3205-035 a (3) requires inclusion of a disclaimer statement.
NRC Manual Chapter 3205 provides the author with definition of and information on page charges, distribution, disclosure, copyright, and publication require-ments, as well as procedures for cases in which the author's opinions differ from NRC positions.
Copies of all papers to be presented or published should be sent to the policy Development and Technical Support Branch of HRR.
- This procedure recognizes that there will be cases in which time constraints for an invited paper dictate acceptance of the invitation before a sumary or an abstract can be prepared.
In these cases, advance division director approval may be given verbally.

Review and Approval of External Communications of the Contractor l
All papers and publications by NRR contractors based on information developed from NRR-supported technical assistance must be reviewed and approved before release. The review and approval of the technical and regulatory content will be coordinated by the technical assistance project manager and will be performed by the lead engineer's assistant director or the next highest management level above branch chief. This review ensures that contractors do not present what may be construed as new and unreviewed NRC policy and that draft and predecisional information is not inadvertently released. The procedure also provides assurance that national security, patent rights, and comercial proprietary rights are not compromised by presentation or publication of papers and journal articles. This procedure irtplements a more stringent review process than the procedures of MC 3206. However, it does not supersede the manual chapter nor repeat all information contained therein. The prospective author or speaker and those responsible for review and approval must refer to both documents for full guidance.
The technical assistance project manager in cooperation with the lead engineer will perform a preliminary review and make recommendations for management review and approval of the technical and regulatory content of the proposed paper or speech. Following this review, the lead engineer will submit the paper, together with his or her coments and recommendations, to the responsible assistant director or other appropriate level of management for review and approval. The technical assistance project manager should ensure that the Statement of Work within the contract contains an explicit statement along the following lines i

The contractor's investigator may publish the results of this work in the open literature if the draft article or paper has been approved by the NRC and agreement has been reached on the content. All requests for approval shall be directed to the technical assistance project manager.
NRR requires that the paper include, in addition to the standard statement " Work supported by the U.S. Nuclear Regulatory Comission," any caveats deemed necessary.
Contractors will not be authorized to present themselves as spokespersons for the Comission on NRC policy issues in papers and journal articles.
Contractor comments on NRC policy issues must be accompanied by a suitable disclaimer, such as:
"The views expressed in this paper (or journal article) are not necessarily those of the U.S. Nuclear Regulatory Commission."
If NRC finds that the information could be construed as new and unreviewed NRC policy or as predecisional, NRC can refuse to authorize publication in the open literature and/or presentation of papers.
In the case of Department of Energy (DOE) national laboratory reports, the DOE operations office manager responsible for the laboratory involved should be informed by the NRC office director's designated officer of the refusal to authorize publication and the reasons therefor, with a copy to the laboratory director.
In the case of another Federal agency, a State, or a private contractor, the person who executed the contract should be informed by the NRC contracting officer.
If ail data and information developed as a result of NRR-supported technical assistance are deleted, the contractor may then publish without NRC identification or citation. This will not affect payment of the contract work costs, but costs for page charges l

MC 3206 should be consulted for requirements regarding patents, copyright provisions, reimbursement of page charges and travel costs, disclosure requirements, definitions, and press or other media releases.
EFFECTIVE DATE This revised office letter is effective immediately.
