OBJECTION TO STAFF MOTION FOR EXTEi4SION OF TIME TO FILE BRI,EF ON BEHALF OF SEACOAST ANTI-POLLUTION LEAGUE 1.

NRC's staff request is untimely.

Staff had ten days from furnishing of applicant's brief, April 24, 1989, to file its brief.

The brief was therefore due on May 4,1989.

I f NRC's s ta f f was served by ordinary mail, NRC's staff brief would have an additional five days, or be due on May 9, 1989.

The extension request was made, and only by telephone, on May 3, 1989, which is not the required seven days before the due date.10 CFR f 2.762.

Staf f has no legitimate reason for an extension.

Schedule for briefing has been set long ago, staf f has been in possession of appellant's arguments since March 24, 1989, staf f has now only one l
