MEMORANDUM AND ORDER For good cause shown, the NRC staff's May 3, 1989 motion for a twenty-three day extension of the time within which to file its brief in response the briefs of the appellants on their appeal from LBP-88-32, 28 NRC 667 (1988), is granted.
In this connection, we are constrained to note that the claim of the Seacoast Anti-Pollution League (SAPL) that the staff's motion was untimely is based upon a serious I
misreading of the Rules of Practice.
For one thing, motions 1
for enlargement of briefing time need be received only one l.
day prior to the date upon which the document in question is I
I then due for filing.

Second, inasmuch as the appellants' briefs were due to be filed (and the last was filed by regular mail) on Earch 24, 1989, the staff's brief was due for filing on May 8,
1989.
See 10 CFR 2.762(c) and 2.710.2 In the future, experienced SAPL counsel should take more care in the reading of the Rules of Practice so as to avoid our being burdened with the assertion of frivolous claims.

Barbara A. Tomptins Secretary to tr.e Appeal Board 1 The seven-day requirement in 10 CFR 2.762(e), to which SAPL presumably alludes, applies in terms only to motions for enlargement of the prescribed page limit for briefs.
2 The SAPL assertion that the staff's brief was due on May 4 (10 days after the applicants' brief was filed on April 24) is totally without merit.
Section 2.762(c) makes clear that the due date for a staff brief as appellee is governed by the expiration of the period for the filing and service of all appellants' briefs.
The Massachusetts Attorney General also maintains that the staff's motion is late.
His argument appears to be based on a perceived conflict between the provisions of 10 CFR 2.762(c) with respect to the filing of responsive briefs and the provisions of 10 CFR 2.730(c) with respect to the filing of responses to motions.
Obviously, no such conflict does or could exist.
