s I am responding to your January 9,1998 fax in which you inquired whether the Nuclear Regulatory Commission (NRC) has en " official" definition of " performance based standard."
- Based on review of 10 CFR Parts 20 and 30, and discussion v3h staff, I am unable to find that NRC has an " official" definition of " performance based standard." I have, however, enclosed for your information and assistance, a recent N9C Announcement, No.114, entitled, " Discussion l
of Safety and Compliance.". This document, recently approved by the Commission, is being incorporated into NRC Enforcement Policy, inspection Manuals and other staff guidance, as appropriate. Finally, since your fax notes that your client is a Maryland licensee and, therefore, subject to regulatory jurisdiction of the State of Maryland, I suggest, that you contact P.Ar. Roland L
Fletcher, Manager of the Maryland Radiological Health Program. Mr. Fletcher may be able to -
provide information on Maryland requirements and their application to your client's activities that are licensed by the State of Maryland.
