The purpose of this Modification No. 17 is to obligate incremental funds in the amount of $20,000.00 for Reimbursable Utility Charges, and to revise Section C.7, " Utilities," to prescribe sales tax on charges for utility services as unallowable costs under the contract.
Accordingly, Contract No. NP,C-10-87-171 is hereby modified as follows:
1.
The amount reflected under Section B.3.C, " Option Year No. 2 - Second Additional Twelve Month Period,", Subsection (C), Total Estimated Amount for Reimbursable Utility Charges," is hereby increased by
$20,000.00 from $585,000.00 to $605,000.00.
2.
Under Section B.4, " Obligation and Consideration," Subsections a, d, and g are deleted in their entirety and the following revised Subsections are substituted in lieu thereof:
"a.
It is estimated that the total cost to the Government for full performance under this contract, inclusive of the basic year, and Option Years 1 and 2, will be $4,732,659.00.
d.
The amount presently obligated for payments to be made in accordance with " Reimbursable Utility Charges" is $1,775,000.00.
g.
The amount presently obligated for performance of the contract is
$4,234,012.00."
3.
Under Section C.7, " Utilities," Subsection 1 is deleted in its entirety and the following revised Eubsection 1 is substituted in lieu thereof:
"1.
The Coatractor shall assume payment of all utility costs, including purchased steam, electricity, gas, oil, coal, water and sewage effective with the implementation of this contract.
Copies of all utility bills shall be submitted with the Contractor's monthly billings.
The NRC will reimburse the Contractor for actual utility costs, excluding sales tax, incurred and paid to l the utility companies The Contractor is hereby notified that the payment of sales tax by the Government is an unallowable cost in accordance with Federal Acquisition Regulatior, Subpart 31.205-41(b)(3)."
All other terms and conditions of the contract remain unchanged.
