From 1960-1976, I worked for General Electric Company in the design, development, and testing of safety and control systems for nuclear plants. These new designs required the detailed evaluation of the technical and ergonometric factors necessary to ensure that operations data presented to operators would provide them with the information necessary to make the proper decisions for safe operation. 3. For the past thirteen years, I have been a independent technical consultant. In that capacity, I have participated in a variety of studies addressing nuclear facility economic, management, and safety issues for various organizations, including the Department of Energy /Sandia National Laboratories, the Swed'sh Government, and the of5ces cf several states' Attorneys General. I am currently a consultant on several nuclear plant cases in which design, management, and compliance with existing regulations are being investigated. 4 I am a member of the Nuclear Power Plant Standards Cormnittee for the Instrument Society of America. Also, I participated in a Peer Review Group of the Nuclear Regulatory Commission's Three Mile Island Special Inquiry Group. San Jose, California 95125. I have previously been employed by the Union of Concerned Scientists as a Technical Research Associate and Risk Analyst from February 1981 to September 1985, and by the Tnree Mile Island Public Interest Resource Center as a Research Coordinator and Project Director from January 1980 to January 1981. I received ~a B.S. in Education, with a major in Earth and Space Science and a minor in Environmental Education, from Shippensburg State College (now Shippensburg University), Shippensburg, Pennsylvania, in 1975. 6. For the last nine and a half years,11: ave been engaged in analyzing technical e nuclear safety, management, design, construction, and regulatory issuet,, and providing technical advice to state and local governments (including the States of California, New York, Illinois, Pennsylvania, Maryland, Maine, Connecticut, and Massachusetts, and Suffolk County, New York) and independent organhations on these issues. I have presented expert testimony concerning these issues in a number of state jurisdictions, as well as before the Atomic Safety and Licensing Board in the Indian Point Special Investigation and the Catawba operating license review. I have also presented expert testimony before the United States Congress and before the SizewellInquiry (United Kingdom). I have previously served as principal investigator for monitoring of startup testing and low power operations for the Shoreham Nuclear Power Station for the New York Consumer Protection Board. Further details of my experience and qualifications are contained in my St=tement of Profeninnal Ounlifications. which is appended to this affidavit as Attachment 2. DISCUSSION 7. On 21 July 1989, we transmitted an affidavit to the Office of the Attorney General, Commonwealth of Massachusetts, which was subsequently filed on that date as Attachment A to " Interveners' Motion to Admit Contention, or, in the Alternative, to Reopen the Record, and Request for Hearing". That affidavit set fonh our understanding of the events of 22 June 1999 based. on information available as of that date. In that affidavit, we concluded that the failure of the operators to manually trip the reactor when the 17% pressurizer level criterion was reached violated 10 CFR 50, Appendix B, Criterion V. ~3-

On 22 August 1989, we received a copy of the NRC staffs " Augmented Inspection Team"(AIT) report on the events of 22 June 1989 (NRC Inspection Report 50-443/8992). Our review of this AIT inspection report indicates that the r eport provides significant new information concerning the events of 22 June 1989. Accordingly, herein we supplement out 21 July 1989 affidavit. Below, based on the staffs AIT report, we identify several additional vioistions of 10 CFR 50, Appendix B, which occurred during and prior to the Natural Circulation Test conducted at Seabrook Unit 1 on 22 June 1939. 9. The AIT inspection report indicates that a prerequisite for the Natural Circulation Test (1-ST-22) was not met in that while the test procedure required the plant staff to confirm the availability of the steam dump system prior to initiating the test, in fact there was an open work order (WR87 WOO 5592) for post maintenance stroke testing of steam dump valve MS-PV-3011 (the valve which failed open during the event). Significantly, the AIT inspection report states for the first time that this stroke test had no1 been performed and the work order had not been closed out, and that the Natural Circulation Test prerequisite (prerequisite 3.6.7) was " signed of' -- indicating that the stroke test had been performed when in fact it had un1 been performed. [Sg, AIT Inspection Report 89-82, at 14 and Enclosure 2] (Note that this is in contrast with the applicants' evaluation with states that the prerequisite was "sutisfied"; sec, Enclosure 4 to NYN-89086, 30.) Accordingly, the Natural Circulation Test should not have taken place until the test prerequisites were met. Instead, the natural circulation test was conducted and the failure of MS-PV 3011 during the performance of the test initiated the transient which occurred during the conduct of the test. This represents a violation of 10 CFR 50, Appendix B, Criterion XI (which specifically requires that test procedures include provisions for assuring that all prerequisites for a test have been met), and Criterion V (which specifically requires that activities affecting quality be prescribed by documented instructions, procedures, or drawings appropriate to the circumstances 4

Post event investigation revealed that MS PV 3011 failed to operate properly due to mechanical binding. For the first time, the AIT inspection repkt states that there was also binding found in valve MS-PV-3019, reather steam dump valve, and that post-event testing of all steam dump valves showed binding, scored stems, h,ose linkage, or tight linkage in seven of the tselve steam dump valves. The AIT teport concluded, "in general, the history of steam dump valve system work orders indicates that there is a valve maintenance or design problem." (See, AIT Inspection Report 89-82, at 14] This is a violation of 10 CFR 50, Appendix B, Criterion XVI, which requires that significant conditions adverse to quality be identified and corrected, and that the cause of the condition be determined and corrective action taken to preclude repetition. The adverse performance history of the steam dump valves represents, in our opinion, a "s/gnificant condition adverse to quality" in general due to the safety function performed by the steam dump valves (,tec, ParaBraph 11, ig(zg), and specifically for the Natural Circulation Test due to its reliance on adequate performance by the steam dump valves. 11. The steam dump valves perform a safety function in that the steam dump valves are part of the steam dump control system which is designed to accept a 50 percent loss of net load without tripping the reactor. [Sce, Seabrook FSAR, Section 7.7.1.8) This system performs an important safety function in that it reduces the rate of challenges to the reactor protection system and other systems which might be called upon to respond following a reactor trip. Thus, the staff's conclusion that there is a " valve maintenance or design problem" with the steam dump valves is safety significant for full power operation. It is also safety significant for the Natural Circulation Test which depends on the steam dump valves for proper operadon in order to carry out the test (hence the test prerequisite requiring the operability of the steam dump valves). Accordingly, the question of whether there is a valve maintenance or design problem with the steam dump valves, 5-

The NRC staff's AIT report provides the first clear Indication that the specific training provided to the operators on the Natural Circulation Test was inadequate in several respects. (This is entirely aparable from the question of whether the operators were adequ trained in the necessi+y for procedural adherence, which they clearly were not.) Specifica AIT report indicates that the operators v.ere last trained on the Seabrook simulator on the Natural Circulation Test on April /May 1986 -- approximately three and a nalf years ago (an notwithstanding an NRC staff recommendation conceming the need for additional simulator training before conducting start-up tests; tre, NRC Inspection Report 8815, at 8). The staff also noted that classroom training was provioed in September / October 1988 as part of the licensed i operator requalification program, however the entim startup testing program was covered in a four-hour course. [Sce, AITInspection Report 89-82, at 17] It is worth noting that there are sorne 50 startup tests described in Chapter 14 of the Seabrook FSAR: this works out to an average o about 5 minutes instruction per startup test for the cited four-hour requalification training lecture This cannot be concluded to have been an adequate " refresher" training on the Natural Circulation Test, particularly considering that it took place nearly a year before the Natural Circulation Test was actually conducted. Moreover, as the AIT report noted, the fact that the natural circulation test simulator training had been performed three years before the test was to be carried out, the fact that the classroom requalification training was almost a year old at the time the test was to be carried out, and the fact that the operators on shift on the morning of the event had not routinely worked together as a crew should have provided added incentive to ensure that the operators received some refresber training and a thorough briefing prior to commencing the test. [Sec, AIT Inspection Report 89-82, at 21] E - -- _ --_ -

The NRC staff's AIT inspection report indicates for the first time that the pre test briefing provided to the shift crew was inadequate. Specifically, the staff noted that the j Operations Management Manual for Seabrook requires that briefings on plant evolutions { involving many individuals or involving complex evolutions should be performed as a crew, not on an individual basis. This was not done. Moreover, the AIT report notes that one of the Control i Room Operators and the Shift Supervisor were never even briefed individually on the test. (Sec, AIT Inspection Report 89-82, at 18) These circumstances represent a violation of 10 CFR 50, Appendix B, Criterion II, which requires that the quality assurance program provide for indoctrination and training of personnel performing activities affecting quality as necessary to assure that suitable proficiency is achieved and maintained. 14. The AIT report provides further support for our conclusion that the operators deliberately disregarded the test criterion for manually tripping the reactor. The AIT report points out that the operators were trained that procedural adherence is required with deviations allowed only after procedure changes have been made or in the case of the emergency response procedures by invoking 10 CFR 50.54(x). Training Department personnel told the AITinspectors that the operators are trained to comply with all approved station procedures, regardless of I whether they are operations procedures, administrative procedures, or test procedures. They l further told the AIT inspectors that the control room operators are instructed to advise the Unit Shift Supervisor when and if the reactor trip criteria are approached and/or exceeded, and to trip the reactor unless directed otherwise by the Unit Shift Supervisor. (Ice, AIT Inspection Report 89-82, at 17-18} Since the USS did not direct the operators not to trip the reactor, the Control l Room Operators should have proceeded to manually trip the reactor in compliance with the test 'l procedure and their training. The NRC's regulations, the plant Technical Specifications, the plant procedures, and the operators' training all mandate procedural compliance. Moreover, the I operators knew and informed the Unit Shift Supervisor that the manual trip criterion was being approached and subsequently was exceeded, and certain personnel were also informed of this by f _ _ - _ _ _ _ _ _

When the reactor was finally tripped, it was apparently for an entirely different reason than the fact that the 17% pressurizer level manual trip criterion had been exceeded. The AIT report states, "The operating crew did not comply with an explicit procedural requirement to manually trip the reactor even though they were fully aware that the established trip criterion had been exceeded. The CROs i shouH have recommended to the USS that the reactor be inpped before level exceeded the 17% pressurizer level criterion." [See, AIT Inspection Report 89-82, at 21] We continue to view this failure to adhere to procedurcs as safety significant. 1 15. The AIT report indicates for the first time that an operator who was designated as the STA performed the' EOP control board manipulations during recovery from the transient. [Sss, AIT Inspection Report 89 82, at 20 and 21] This is inconsistent with the significant role played by an STA. The AIT report noted, "If the EOP recovery had been extended, the inspectors were uncertain whether this operator would have beenfree toperform his STA responsibilities." [Sec, AITInspection Report 89-82, at 20] 16. The staff AIT report also concludes, for the first time, that the Shift Supervisor's level of awareness, knowledge, and involvement in the shift evolution durmg the test "*cs not commensurate with the significance and complexity of this test" The AIT report consinues, "Thefact that the natural circulation test is one of thefirst evolutionsperformed with a criticalreactor and the fact that the test involves abnormal operating conditions should have been sufficient to raise the SS's levelofawareness and involvement." [R, at 21-22) In addition, the AITinspection report indicates that Shift Supervisor had not been briefed on the conduct of the Natural Circulation Test, and did not have a copy of the test procedure available to him during the test. [E,at18] These l circumstances violate 10 CFR 50, Appendix B, Criterion XVI, in that the Shift Supervisor was not l sufficiently informed to exercise the quality functions of promptly identifying and correcting i conditions adverse to quality during the conduct of the Natural Circulation Test (by assuming 8

The failures in performance of personnel, as demonstrated during and prior to the events of 22 June 1989, are safety significant. Our view is consistent with the AIT report which concluded that the following aspects of the performance of licensee personnel were "suferv significant": the failure of the operating crew to trip the reactor when required by the test procedure; the failure of test group perwnnel to recommend tripping the reactor; the failure of management present in the control room to exercise their responsibilities despite the fact that the p: ant was being operated under a Technical Specification Special Test Exempticn; and the " apparent willingness" of management to proceed with testing following the 22 June 1989 event without first completing a thorough review and causal factor assessment. In addition, the staff concluded that the operational practice exhibited by the personnel in the control room was " unacceptable". [Seg, AIT Inspection Report 89-82, at 29-30) 18. In conclusion, muldple violations of 10 CFR 50, Appendix B, have been identified during the performance of the Natural Circulation Test and the time period leading up to the conduct of the test. l i 9-J
