NRC-17-89-120 section I I.4 SERVICE CONTRACT ACT OF 1965, AS AMENDED (52.222-41)

(MAY 1989)

(a) Definitions. "Act," as used in this clause, means the Se vice Contract Act of 1965, as amended (41 U.S.C. 351, et seq.).

" Contractor," as used in this clause or in any subcontract, shall be deemed to refer to the subcontractor, except in the term

" Government Prime Contractor."

" Service employee," as used in this clause, means any person engaged in the performance of this contract other than any person employed in a bona fide executive, administrative, or professional capacity, as these terms are defined in Part 541 of Title 29, Code of Feoeral Regulations, as revised. It includes all such persons regarcless of any contractual relationship that may be alleged to exist between a Contractor or subcontractor and such persons.

(b) Applicability. This contract is subject to the following provisions anc to all other applicable provisions of the Act and regulations of the Secretary of Labor (29 CFR Part 4). This clause does not apply to contracts or subcontracts administratively exemoted by the Secretary of Labor or exempted by 41 U.S.C. 356, as interpreted in Subcart C of 29 CFR Part 4.

(c) Compensation. (1) cacn e vice employee employeo in the performance of this contract by the Contractor or any subcontractor shall be paid not less than the minim.um monetary wages and shall be furnished fringe benefits in accordance with the wages and fringe benefits determinea by the Secretary of Labor, or authorized representative, as specified in any wage determination attached to this contract.

(2)(1) If a wage determination is attached to this contract, the Contractor shall classify any class of service employee which is not listed therein and which is to be employed under the contract (i.e.,

the work to be performed is not performeo by any classification listec in the wage determination) so as to provide a reasonable relationship (i.e., appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination. Such conformed class of employees shall be paid the monetary wages and furnished the fringe benefits as are determined pursuant to the procedures in this paragraoh (c).

(ii) This conforming procedure shall be initiated by the Contractor priur to the performance of contract work by the unlisteo class of employee. The Contractor shall submit Standard Form (SF) 144a, Request for Authorization of Additional Cla',sification and Rate, to the Contracting Officer no later than 30 days after the unlisted class of employee performs any centract work. The Contracting Officer shall review the proposed classification and rate and promotly submit the comoleted SF 1444 (which must include information regarding the agreement or disagreement of the employees' autr.orized representatives or the employees themselves ,

& HRC-17-89-120 information to the Wage and Hour Division, Employment Standards Administration U.S. Department of Labor. The Wage and Hour Division will' approve, modify, or disapprove the action or render a final determination in the event of disagreement within 30 days of receipt or will notify the Contracting Officer within 30 days of receipt that additional time is necessary.

. (iii) The final determination. of the conformance action by the Wage and Hour Division shall be transmitted to the Contracting i Officer who shall promptly notify the Contractor of the action taken. Each affected employee shall be furnished by the Contractor with a written copy of such determination or 1t shall be posted as a

part of the wage determination.

.(iv)(A) The process of establishing. wage and fringe benefit rates that bear a reasonable. relationship to those listed in a wage determination cannot be reduced to any single formula. The approach usec may vary from wage determination to wage determination deoending on the circumstances. Standard wage and salary administration oractices which rank various job classifications by pay grade pursuant to point schemes or other job factors may, for examole, be relied upon. Guidance may also be obtained from the way different jobs are rated under Feceral pay systems (Federal Wage Boarc Pay System and the General Schedule) or from other wage determinations issued in the same locality. Basic to the establishment :f any conformable wage rate (s) is the concept that a pay relationsnic should be maintained between job classifications basec on the s<.ill required and the duties performec.

(B) In the :ase of a contract modification, an exercise of an option, or extension of an existing contract, or in any other case where a Contra::or succeeds a contract under which the classification in question was previously conf .med pursuant to paragraph (c) of this clause, a new conformed wage rate and fringe benefits may te assigned.to the conformed classification by indexing (i.e., adjusting) the previous conformed rate and fringe benefits by an amount equal to the average (mean) percentage increase (or decrease, where appropriate) between the wages and fringe benefits specified for all classifications to be used on the contract which are listed in the current wage determination, and those specified for the corres:ending classifications in the previously applicable wage determination. Where conforming actions are accomplished in accordance witr. this paragraph prior to the performance of contract work by the unlisted class of employees, the Contractor shall advise the Contracting Officer of the action taken but the other procedures in subdivision (c)(2)(ii) of this clause need not be followed.

(C) No emoicyee engaged in performing work on this contract shall in any event ce paid less than the currently applicable minimum wage specified unce* section 6(a)(1) of the Fair Labor Standards Act of 1938, as amencec.

(v) The wage rate and fringe benefits finally determined under this subparagraon (c)(2) of this clause shall be paic to all -

which contract work is performed by them in the classification.

F91ure to pay the unlisted employees the compensation agreed upon by tae i-nterested parties and/or finally determined by the Wage and Hour Division retroactive to the date such class of employees commenced contract work shall be a violation of the Act and this contract.

(vi) Upon discovery of failure to comply with subparagraph (c)(2) of this clause, the Wage and Hour Division shall make a final determination of conformed classification, wage rate, and/or fringe benefits which shall be retroactive to the date such class cr classes of employees commenced contract work.

(3) Adjustment of Compensation. If the term of this contract is more than 1 year, the minimum monetary wages and fringe benefits required to be caid or furnishec thereunder to service employees unoer this contract shall be subject to adjustment after 1 year and not less often than once every 2 years, under wage determinations issued by the Wage and Hour Division, (d) Obligation to Furnish Fringe Benefits. The Contractor or subcontractor may discharge the obligation to furnish fringe benefits specified in the attachment or determined uncer suoparagrapn (c)(2) of this clause by furnishing equivaient combinations cf bona fide fringe benefits, or by making eouivalent or differential cash payments, only in accorcance with Subpart D of 29 CFR Part 4 (e) Minimum Wage. In the absence of a minimum wage attachment for this contract. neither the Contractor nor any subcontractor uncer this contract shall pay any person performing work uncer this contract (regardless of whether the person is a service employee) less than the iinimum wage specified by section 6(a)(1) of the Fair Labor Stancarcs Act of 1938. Nothing in this clause shall relieve the Contractor or any subcontractor of any other obligation under law or contract for payment of a higher wage to any emcloyee.

(f) Successor Contracts. if this contract succeeds a contract subject to the Act under which substantially the same services were furnished in the same locality and service employees were paid wages and fringe benefits provided for in a collective bargaining agreement, in the absence of the minimum wage attachment for this contract setting forth such collectively bargained wage rates and fringe benefits, neither the Contractor nor any subcontractor under this contract snali pay any service employee performing any of the contract work (regardless of whether or not such employee was employed unoer the predecessor contract), less than the wages and fringe benefits provided for in such collective bargaining agreement, to which such employee would have been entitled if employed unoer the predecessor contract, including accrued wages ano fringe benefits and any prospective increases in wages and fringe l benefits provided for uncer such agreement. No Contractor or subcontractor under this contract may be relieved of the foregoing obligation unless the limitations of 29 CFR 4.lb(b) aoply or unle' ,

  • Page.4 NRC-17-89-120 .Section I finos, after a hearing as provided in 29 CFR 4.10 that the wages and/or fringe benefits provided for in such agreement are substantially at variance with those which prevail for services of a character similar in the locality, or determines, as provided in 29 CFR 4.1.1, that the collective bargaining agreement applicable to service employees employed under the predecessor. contract was not entered into as a result of arm's length negotiations. Where it is found in accordance with the review procedures provided in 29 CFR 4.10 and/or 4.11 and. Parts 6 and 8 that some or all of the wages and/or fringe benefits contained in a predecessor Contractor's collective bargaining agreement are substantially at variance with those which prevail for services of a character similar in the locality, anc/or that the collective bargaining agreement applicable to service emoloyees employed under the predecessor contract was not entered into as a result of arm's length negotiations, the Department will issue a new or revised wage determination setting forth the applicable wage rates and fringe benefits. Such determination snall be made part of the contract or subcontract, in accordance with the dec1sion of the Administrator, the Administrative Law Judge, or the Board of Service Contract Appeals, as the case may be, irrespective of whether sucn issuance occurs prior to or after the award of a cont.act or subcontract (53 Como.

Gen. 401 (1973)). In the case of a wage determination issued solely as a result of a finding of substantial variance, such determination shall be effective as of the date of the final administrative decision.

(g) Notification to Employees. The Contractor and any subcontractor under this contract shall notify each service employee commencing work on this contract of the minimum monetary wage ano any fringe benefits reauired to be paid pursuant to this contract, or snail post the wage determination attached to this contract. The poster provided by the Department of Labcr (Publication WH 1313) shall be' posted in a prominent and accessible place at the worksite.

Failure to comply with this requirement is a violation of section 2(a)(4) of the Act and of this contract.

(h) Safe and Sanitary Working Conditions. The Contractor or subcontractor shall not permit any part of the services called for by this contract to be performed in buildings or surroundings or under working conditions provided by or under the control or supervision of the Contractor or subcontractor which are unsanitary, hazardous, or dangerous to the health or safety of the service employees. The Contractor or subcontractor shall comply with the safety and health standards applied under 29 CFR Part 1925.

(i) Recores. (1) The Contractor and each subcontractor performing work subject to the Act shall make and maintain for 3 years from the completion of the work, and make them available for inspection and transcription oy authorized representatives of the Wage and Hour Division, Employment Stancards Administration, a record of the following:

(i) For eacn employee subject to the Act -- ,

(B) Correct work classification or classifications, rate or rates of monetary wages paid and fringe benefits provided, rate or rates of payments in lieu of fringe benefits, and total daily and weekly compensation; (C) Daily and weekly hours worked by each employee; and (D) Any deductions, rebates, or refunds from the total daily or weekly compensation of each employee.

(ii) For those classes of service employees not included in any wage determination attached to this contract, wage rates or fringe benefits determined by the interestad parties or by the Administrator or authorized representative under the terms of paragraph (c) of this clause. A copy of the report recuired by subdivision (c)(2)(ii) of this clause will fulfill this requirement.

(iii) Any list of the predecessor Contractor's employees which had been furnished to the Contractor as prescribed by paragraoh (n) of this clause.

(2) The Contractor shall also make available a copy of this contract for inspection or transcription by authori:ed representatives of the Wage anc Hour Division.

(3) Failure to make and maintain or to make available these records for inspection and transcription shall be a violation of the regulations and this contract, and in the case of failure to produce these records, the Contracting Officer, upon direction of the Department of Labor and notification to the Contractor, shall take "~

actior to cause suspension of any further payment or advance of funcs until the violation ceases.

(4) The Contractor shall permit authorized representatives of the Wage and Hour Division to concuct interviews with emoloyees at the wor (site during normal working nours.

(j) Pay Periods. The Contractor shall unconditionally pay to eacn employee subject to the Act all wages due free and clear and without subsecuent deduction (except as otherwise provided by law or Regulations, 29 CFR Part 4), rebate, or kickback on any account.

These payments shall be made no later than one pay period following the end of the regular pay period in which the wages were earned or accrued. A pay period under this Act may not be of any duration longer than semi-monthly.

(k) Withholding of Payments and Termination of Contract. The Contracting Officer shall withhold or cause to be withheid from the Government Prime Contractor uncer this or any other Government contract with the Prime Contractor such sums as an appropriate official of the Department of Labor reouests or sucn sums as the Contracting Officer decides may be necessary to pay undereaid -

employees employed by the Contractor or subcontractor. In the event u __

  • NRC-17-89-120 of. failure to pay any employees subject to the Act'all or part of the wages or fringe benefits due under the Act, the Contracting Officer'may, after authorization or by direction of the Department' -

of' Labor-and written notification to the Contractor, take action to cause suspension of any_ further payment or advance of funds until such violations have- ceased. Additionally, any failure to. comply with the requirements of this clause may be grounds for termination of the right to proceed with the contract work. In such event, the Government may enter into other contracts or. arrangements for-completion of the work, charging the Contractor-in default with any additional cost.

(1) Subcontracts. The Contractor agrees to insert this clause in all subcontracts subject to the Act.

(m) Collective Bargaining Agreements Applicable to Service E=Dioyees. If wages to be paid.or fringe benefits to be furnished any service emoloyees employed by the Government Prime Contractor or any subcontractor under the :entract are provided for in a collective bargaining agreement which is or will be effective during any period in which the contract is being performed, the Government Prime Contractor shall report such fact to the Contracting Officer, ,

together with full information as to the application and accrual of sucn wages and' fringe benefits, including any prospective increases, to service employees engaged in work on the contract, and a copy of the collective bargaining agreement. Such report shall be made upon commencing performance of the contract, in the case of cellective bargaining agreements _ effective at such time, and in the case of sucn agreements or provisions or amendments thereof effective at a later time curing the period of contract performance such agreements shall be reported promptly after negotiation thereof.

(n) Seniority List. Not less than 10 days prior to completion of any contract being performed at a Federal facility where service employees may be retained in the performance of the succeecing contract and subject to a wage determination which contains vacation or other benefit provisions based upon length of service with a Contractor (predecessor) or successor (29 CFR 4.173), the incumbent Prime Contractor shall furnish the Contracting Officer a certified list of the names, of all service employees on the Contractor's or subcontractor's payroll during the last month of contract performance. Such list shall also contain anniversary dates of employment on the contract either with the current or predecessor Contractors of each such service employee. The Contracting Officer shall turn over such list to the successor Contractor at the commencement of the succeeding contract.

(o) Rulings and Interpretations. Rulings and interpretations of  !

i' the Act are contained in Regulations, 29 CFR Part 4 (p) Contractor's Certification. (1) By entering into this contract, the Contractor (and officials thereof) certifies that neither it (nor he or she) nor any person or firm who has a substantial interest in the Contractor's firm is a person or firm ~

(2) No part of this contract shall be subcontracted to any person or firm ineligible' for award of a Government contract under section 5 of the Act.

(3) The penalty for making false statements is prescribed in the U.S. Criminal Code, 18 U.S.C. 1001.

(q) Variations, Tolerances, and Exemptions Involving Employment.

Notwithstanding any of the provisions in paragraphs (b) through (o) of this clause,.the following employees may be employed in accordance with the following variations, tolerances, and exemptions, which the Secretary of Labor, pursuant to section '(b) 4 of.the Act prior to its amencment by Pub. L.92-473, found to be necessary ano proper in the public interest or to avoid serious impairment of the conduct of Government business.

(1) Apprentices, student-learners, and workers whose earning capacity is imoaired.by age, physical or mental deficiency or injury may be employed at wages lower than the minimum wages otherwise recuirec by section 2(a)(1) or 2(b)(1) of the Act without diminishing any fringe benefits or cash payments in lieu thereof required uncer section 2(a)(2) of the Act, in accordance with the cone;tions and procedures prescribed for the employment of apprentices, student-learners, handicapped persons, anc handicapped clients of sneitered workshops under section 14 of the Fair Labor Stancarcs Act of 1938, in the regulations issued by the Administrator (29 CFR Parts 520, 521, 524, and 525).

(2) The Administrator will issue certificates under the Act for the employment of apprentices, student-learners, handicapped persons, or handicapped clients of shelterec workshops not subject to the Fair Labor Stancards Act of 1938, or subject to different minimum rates of pay uncer the two acts, authorizing appropriate rates of minimum wages (but without changing requirements concerning fringe benefits or supplementary cash payments in lieu tnereof),

applying procecures prescribed by the applicaole regulations issued under the Fair Labor Standarcs Act of 1938 (29 CFR Parts 520, 521, 524, and 525).

(3) The Administrator will also withdraw. annul, or cancel such certificates in accordance with the regulations in 29 CFR Parts 525 and 528.

(r) Apprentices. Apprentices will be permitted to work at less  !

than the predetermined rate for the work they perform when they are i

employed anc individually registered in a bona fide apprenticeship program registered with a State Apprenticeship Agency which is recognizec by the U.S. Department of Labor, or if rio such recognized agency exists in a State, uncer a program registered with the Bureau

The allowable ratio of apprentices to. journeymen employed on the contract work in any craft classification shall not be greater than the ratio permitted to the Contractor as to his entire work force under the. registered program.

(s) Tips. An employee engaged in an occupation in which the employee customarily and regularly receives more than 530 a month ir, tips may have the amount of these tips credited by the employer against the minimum' wage required by section 2(a)(1) or section -

(a) This clause applies to botn contracts subject to area prevailing wage determinations anc contracts sucject to collective bargaining agreements.

(b) The Contractor warrants that the prices in this contract do not incluce any allowance for any contingency to cover increased costs for which adjustment is provided uncer this clause.

(c) The wage determination, issued under the Service Contract Act of 1965, as amended, (41 U.S.C. 351, et sec.), by the Administrator, Wage anc Hour Division, Employment Standarcs Administration, U.S.

Department of Labor, current on the anniversary date of a multiple year contract or the beginning of each renewal optien period, shall apply to this contract. If no such determination has been made applicaole to this contract, then the Federal minimum wage as established by section 6(a)(1) of the Fair Labor Stancards Act of 1938, as amenced, (29 U.S.C. 206) current on the anniversary date of a multiple year contract or the ceginning of each renewal option perioc, shall apply to this contract.

(e) Any adjustment will be limited to increases or decreases in wages and fringe benefits as described in paragraph (c) of this clause, and the accompanying increases or decreases in social security and unemployment taxes and workers' compensation insurance, but shall not otherwise include any amount for general and administrative costs, overhead, or prcfit.

(f) The Contractor shall' notify the Contracting Officer of any increase claimed under this clause within'30 days after receiving a new wage determination unless this notification period is extendec in writing by the Contracting Officer. The Contractor shall promptly notify the Contracting Officer'of any decrease under this clause.

Section C - Description / Specifications / Work Statement C.1 Statement of Work C.I.1. Background The U.S. Nuclear Regulatory Commission's (NRC) Public Document Room (PDR), currently located at 2120 L Street, N.W., Washington, D.C., provides the public access to copies of documents maintained by NRC. As a part of this service, the NRC requires electrostatic copying services be provided at that location so documents can be obtained -

by the publ.ic and mail requests can be satisfied. (See Attachment 1 "PDR User's Guide.")

C.I.2 Scope of Work The contractor shall furnish all labor, equipment, materials,.and supplies, except as specified or otherw ee rein, to provide reproduction, document provided he,d related services to the public and the PDR delivery tn (acting as a public representative for telephonic or let-ter requesters) related to paper to paper reproduction, microform to paper (blowback) reproduction, and micraform to microform reproduction. Services as may be required hereunder shall consist of: (1) picking up orders and documents from a designated table in the PDR, (2) filling l reproduction orders for documents as listed on NRC order  ;

forms or on letters to the PDR, (3) copying from paper and duplicating or producing blowbacks from microform, (4) collating, (5) stapling pages or rubber banding large stacks of paper (6) answering inquiries on the status of reproduction orders, (7) completing the financial transactions with the public for services rendered, (8) ,

i providing the filled order to the public via pickup by the public at the PDR or via mailing / shipping to the public, and (9) refiling some documents and returring i others to a central location in the PDR.

The.PDR User's Guide (see Attachment-1) provides an overview of PDR' services. Additional background

.information on types of documents, document media, physical ~ arrangement of documents, reproduction order forms, and the placement of reproduction orders follow:

C.1.3.1 Types of Documents A document may be a letter, a drawing, a regulation, a.

formal . printed report, an informal. report, a legal document, a transcript, etc. A document can be a." single document" (one document) or a " document package" (a s

forwarding letter or memorandum with one or more " single documents" as an attachment or enclosure). The " single document" has a page range from one to over 3,000 pages and may contain some oversize drawings. The document package has a page range from 2 pages'to over 10,000 pages and may contain some oversize drawings.

C . I .~ 3. 2 Document Media The media for documents in the PDR consist of pa;er and microform (microfiche or aperture cards). A given document can be on paper, microform, or both media.

Paper documents are almost all on 8 " x 11" loose-leaf or stapled sheets; however, there are also some 17" x 11" document foldout pages, some 8-1/2" x 14" pages, some 17"'

x 8" pages of formal reports and very few 14-7/8" x 11" computer page printouts. In addition, there are oversize items (larger than 17" x 11") such as drawings (a few of them are of a blueprint nature). There are very few documents with a glued spine or documents with pages smaller than 8-h" x 11". In general, almost all paper documents are located in folders or in 3-ring binders.

Microfiche may contain one or more " single documents" or

" document packages." The microfiche have the following-reduction ratios: 20X (12 columns with 5 or 6 rows), 24X (14 columns and 7_ rows), and 48X. There are two types of 48X (see Attachment 3): the ARMS microfiche (produced by NRC) have 28 columns and 13 rows; and IHS microfiche (produced by a commercial firm, IHS) have 28 columns and 14 rows. The 48X ARMS collection represents almost ali of the NRC documents made publicly available since l

October 1978. Documents are randomly filmed as received

[ on the ARMS microfiche and are found by means of a microfiche address consisting of the microfiche number and the beginning and ending frame numbers; the 5-digit I microfiche number appears in the upper left hand corner on the microfiche. The contractor maintains (marks, files and keeps complete) a collection of 48X ARMS

L C.1.3.3 Physical Arrangement of Documents The shelf arrangement of paper. documents in the PDR is a fur.ction of. the number of pages in. a document and the PDR file to which it belongs: one document may be in a folder (this includes tab or expandable file folders as i well as 3-ring binders); one large document may be divided over a number of folders; or, most likely a number of documents arranged in a date order may exist in one folder. There are a few cases in which a formal printed document stands alone and is not in a folder.

The term " folder" will also include these items. Folders and documents are organized in varying ways based on the document type or subject and may be filed by date, by POR alphanumeric file code or by both date and code. The folders may have a metal clip or an Ames Easiclip fastener (see Attachment 4) holding the documents in place within the folder. Microfiche documents are in microfiche envelopes or 8-h" x 11" microfiche panels containing one or more microfiche.

C.I.3.4 Reproduction Order Forms There are three government supplied preprinted NRC tripartite order forms (Attachments 5, 6, and 7). The forms are legal size, carbonless, and contain copies for the onsite requester, the recipient, and the contractor.

or acceptable substitute will be submitted with or in lieu of the form. The SPECIAL INSTRUCTIONS Block on the form serves a variety of purposes. The requester may indicate in that block that several different order forms are to be linked together as one large order for pickup _

or mailing / shipping at the same time to the requester or recipient. This block may also contain the name of the onsite requester or the PDR staff member to be contacted by the contractor should a problem arise concerning the order. The requester is requested to time and date stamp (

all order forms and place them with the appropriate foldert and/or microforms on a designated table in the PDR rrdng room. An order is defined as the order form (s) or acceptable sub'stitutes plus folder (s) and/or microform (s) from which copies are to be made. Orders for documents to be blown back from or diazos of 48X ARMS ,

microfiche will usually be submitted without attached  ;

fiche. The contractor will then be required to obtain these fiche from the contractor maintained 48X ARMS collection as described in Section H.6. 5. ,

C.I.3.5 Placement of Reproduction Orders

' Orders for reproduction services are submitted to the contractor via a pickup table in the pDR by the following:

The requester is responsible for specifying documents to be copied. The contractor will not be expected to make subjective decisions about documents to be reproduced.

When the contractor receives non-letter inquiries from the public to order documents for them, the contractor shall inform the public that orders are placed through the PDR, not through the contractor; letter inquiries shall be given to'the PDR.

Except for 48X ARMS microfiche maintained by the contractor (see' Section H.6.5), the onsite public requester or the PDR staf' member.will retr.ieve documents from the PDR which will be attached to the order forms described herein. -

C.2 Types of Reproduction Services to be Performed by the Contractor C.2.1 General All contractor ma nines used for the performance of this contract shall be of such quality and routinely maintained so as to eliminate frequent periods of inoperability that would prevent meeting the delivery requirements and qualifications set forth herein. All machines installed onsite in the PDR shall be used exclusively for reproduction work perfomad for NRC PDR ,

requesters. Since PDR documents are of varying quality, even within a document package, the contractor shall be responsible for monitoring the legibility and accuracy of completed orders. The contractor shall hal+ reproduction when he notices that requested documents are not legible for reproduction; he shall bring this to the attention of the requester to save the requester additional reproduction costs. When the requester cannot be contacted by telephone within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />, the contractor shall bring this problem to the attention of the Project Officer.

C.2.2 Paper to Paper C.2.2.1 Paper to Paper Reproduction Services Contractor furnished onsite equipment shall have the capability of reproducing 8 " x 11" and 8 " x 14" documents, and providing reduced size pages from 17" x 11", 14-7/8" x 11" and 17" x 8" pages to preferably 8 "

x 14" pages to maintain readability; all rer roduced work shall ba properly collated, stapled (rubberbanded for a large number of pages), and be in black image on white bond paper. The contractor shall also have the capability to provide offsite reproduction of both blueprints and blueline or blackline engineerirm drawings. For drawings 24" in width or less, trie contractor shall use the xerographic process (Xerox 2080 or comparable) and offer reduced size and full-size prints on white bond paper. For drawings exceeding 24" in width and with a maximum length of 42", the contractor shall be capable of providing full size prints using the photographic process.

The contractor shall provide reproductions to the public that are com plete, clearly legible, centered on the sheet, reflect uniform density throughout the image, and are free from any excessive background or toning.

The contractor shall replace at no charge to the recipient any copies failing to conform to these -

standards.

C.2.2.2 Paper to Paper Document Reproduction Order Forms

~

The requester identifies documents and/or specific pages required for reproduction. The requester paperclips (or rubberbands for large number of pages) those documents or pages of documents to be reproduced from the folders by the contractor. The requester completes an NRC-furnished

" DOCUMENT DUPLICATION REQUEST" form - NRC 171 (see Attachment

5) and paperclips this form to the folder (s). For letter requests addressed to the PDR from the public, the requester's letter (after processing by the PDR staff) will be accepted in lieu of the " DOCUMENT DUPLICATION REQUEST" form.

When the PDR receives a letter, a log neber with fcur digits in the format of #### is recorded by the PDR on the top of the 1ctter. The majority of these letters contain all the pertinent information for mailing and billing and are therefore given by the PDR staff to the contractor as a substitute or as an addition to this or any other preprinted NRC order form. A logged letter shall be considered an order form. Since the time for obtaining documents for these letters varies, the letters will not necessarily be given in sequential order to the .

4 contractor. .The same letter may be'given to the contractor on several occasions with a PDR recording of

" partial order" or " completed." When a letter request contains a purchase order number, this number is marked' by the PDR staff to alert the contractov of this fact for billing.

< Certain types of documents are of interest to more than one requester on a regular basis. The PDR wi11' maintain

' standing order folders containing names and addresses of those requesters who have given the PDR written.

authorization to reproduce these dec ments as-they are received. This folder shall be submit 1.ed to the contractor with the documents and will be accepted without pre printed order forms. To enable the requester to easily identify standing orders, a cover sheet will be sent with each standing order. This cover sheet will give the PDR assigned acronym for the standing order, the date upon which a particular group of documents is being sent to the contractor and a consecutive' number

. indicating the times the standing order has gone to the contractor in a given year (for example 16 indicating the 16th time in 1989). The PDR acronym and the consecutive number should be used by the contractor as a reference number for billing purposes (for example 50-LER-16).

After the orders are completed, the standing order folder and documents will be returned to the PDR staff.

C.2.2.3 Paper to Paper Reproduction Orders The contractor shall disassemble, copy, reassemble, and restaple the original document, and reassemble the file folders. The copies made shall be assembled, collated and stapled (when the original document was stapled) or rubber-banded for large documents. Minimum standard of performance for accuracy in accomplishment of these actions is 98 percent.

When a paper document with a spine is submitted with an order form, the contractor shall check with a PDR staff member to obtain permission to cut off the spine to aid in reproduction. In most' cases, permission is given (99%). If permission is not given .the contractor shall still perform the reproduction.

  • When an order form exists for all pages from more than one folder, the contractor shall identify the pages belonging to each folder. This will enable the requester to read the pages sequentially as they appeared in the i folders. An example would be a large multi-volume document or document package or a set of related folders which constitute a " reading file." The contractor may reproduce a copy of the label on the folder and treat it as the first page for the stack of pages produced from that folder.

contractor and the tubing, the U-shaped extension clip or l the bar is broken or discovered to be' broken it shall be replaced by the contractor with the government supplied item; when the U-clip is broken off in the tubing, the tub' q can be cut by the contractor to permit his insse;1on of a new U-clip. If the folder itself is i breaking, the contractor shall return the folder to the POR for repair by the pDR staff.

C.2.3 Microform to paper C.2.3.1 Microform to Paper (Blowback) Reproduction Service Contractor furnished onsite equipment shall have capabilities to provide white bond paper blowbacks with black images from microfiche.

The contractor shall provide b hwoacks from microforms.

The microforms to be blownback consist of second generation aperture cards and silver or first/second generation microfiche, with the following reduction ratios: 20X (60 and 72 frames), 24X (98 frames), and 48X (364 and 392 frames). The contractor shall provide aperture card blowbacks in both full size and reduced.18" x 24" size prints on bond paper.

The contractor shall provide blowback reproduction to the public that is clearly legible, centered on the sheet, reflects unifonn density througnout the image, and is free from any excessive background or toning; all paper copies

C.2.3.2 Microfiche to Paper (Blowback) Reproduction Order Forms The requester completes the " MICROFORM BLOWBACK. REQUEST" form - NRC 171B (see Attachment 6) identifying the microfiche number and the frames to be blownback to l paper. When the document to be blownback is not on 48X ARMS microfiche, the microfiche will always be attached to the order form by the requester. When the document j requested is on 48X ARMS microfiche, the microfiche will usually not be attached to the NRC order form by the requester. The case in whict microfiche are not attached is explained under Section C.2.3.3. The requester may also choose to attach a clearly marked computer printout or other listino with sufficient 48X ARMS identification information to a pre-printed blowback form with Section 3 l

For letter requests being fulfilled with 20X and 24X blowbacks, the pre printed form need not be attached if the request. involves blowbacks of all frames of all submitted fiche. If the order requires only partial blowback of any submitted fiche, a pre printed form will be attached to the order specifying which frames are to be blownback. The PDR. staff will record only the letter log number in the BILLING DATA Block of the pre printed' NRC order form; as the letter will be attached to this NRC request form. For letter requests being fulfilled with 48X ARMS blowbacks, the same procedures for 20X and 24X blowbacks may be followed; on the other hand, when sufficient 48X ARMS microfiche identification information is recorded on the letter or its attachments (for example, clearly rarked computer printouts or POR accession list pages), the letter will substitute for the pre printed NRC order form. The contractor will return the printout or other acceptable listing to the r w ester with the completed order.

C.2.3.3 Microform to Paper (Blowback) Reproduction Orders The contractor shall staple.or rubberband each multi page paper document produced from microfiche. When multiple documents on a single microfiche are marked by the -

requestar on the blowback form with special consequential E.id locations, the contractor shall keep consequential grids separate and staple or rubberband each document or set of pages accordingly. When an order form exists for all pages of a multi-microfiche document (s), the contractor shall identify the pages for each microfiche. '

This will enable the requester to read the pages sequentially as they appeared on the sequential microfiche. This may be accomplished by providing a number and or a brief identification of the microfiche on a cover sheet for each stack of pages; the stacks may j represent one or more microfiche documents identified on the order form.

'When the document reque'sted is on 48X ARMS microfiche, the microfiche may or may not be attached to an order form. When the microfiche are not attached to the l request form, the contractor shall pull the designated ARMS microfiche from the contractor maintained collection (see Section H.6.5) and use these microfiche to blowback the frames requested. When the PDR copy of the 4JX ARMS l microfiche is attached to the order form, the contractor l may use this copy to blowback the requested frames, but the contractor shall take whatever steps are necessary to  !

the contractor's ARMS collection. Sometimes different orders will call for the use of the same contractor-maintained microfiche. In such cases, it is the contractor's responsibility to establish procedures to ensure that both orders can be completed within their

. respective turnaround times. In other words, fiche out of file is not an acceptable' excuse for not completing orders within established turnaround times.

The contractor shall. return all PDR microfiche to the exact same. envelopes from which they were retrieved; all microfiche shall be placed in envelopes so that the headers are readable from the front of.the envelope.

When a slip sheet appears in a pDR microfiche envelope, that separates the first and second microfiche, the contractor shall return the slip sheet to the same position in the PDR anvelope.

The contractor shall record the identifying number recorded on the pDR aperture card on the prints provided to the requester.

C.2.4 Microform to Microform C.2.4.1 Microform to Microform Reproduction Service The contractor shall (onsite and/or offsite) make third generation diazo duplicates of second generation aperture cards, and microfiche or first generation diazo .

duplicates of silver microfiche; medium contrast film shall be used in microform duplication.

Image resolution loss of a given generation diazo duplicate shall not be more than.one pattern of the National Bureau of Standards ~ Resolution Test Target of the previous generation microform; there shall bc. no more than 20 percent loss of background density; and the base plus clear area shall remain the same.

The contractor shall provide diazo duplicates of microfiche on a 5 mil. thick, clear, polyester base and each diazo placed :n an individual plain protective envelope for the requester. The contractor shall record the identifying number recorded on the PDR aperture card  !

on the duplicate card.

All contractor duplicated microforms shall be free of scratches, holes, tears, fingerprints, dirt, dust, or any defect that would adversely affect their usability.

The contractor shall replace at no charge to the recipient any duplicated microforms failing to conform to the above requirements. ,

C.2.4.2 Microform to Microform Reproduction Order Forms

If they are not, the contractor will use the contractor-maintained set of 48X ARMS microfiche to complete the order. For letter requesters, the contractor will accept a clearly worded or notated letter in lieu of the pre printed form.

C.2.4.3 Microform to Microform Reproduction Orders The contractor shall return all PDR microfiche to the exact same envelopes from which they were retrieved; each microfiche duplicated for the public shall be placed in an individual envelope and all PDR microfiche and microfiche duplicated for the public shall be placed in envelopes so that the headers are readable from the front of the envelope. When a slip sheet appears in a PDR microfiche envelope, that separates the first and second microfiche, the contractor shall return the slip sheet to the same position in the PDR envelope.

The contractor shall record the identifying number recorded on the PDR aperture card on the duplicated card.

C.3 Document Pickup.of Reproduction Orders At least every half hour on Federal government work days (Monday through Friday, 7:45 a.m. - 4:15 p.m.), the contractor shall pick up reproduction orders from the pick-up table in the PDR reading room and transport them to the onsite location in the POR where the contractor's reproduction equipment shall be installed. An order includes the order form (s) or letter (s) plus folder (s) and/or microform (s); 48X ARMS microfiche may not always be attached. At this time, the contractor shall also check the coin-operated machine (see Section H.6.4) to ensure an adequate supply of toner / developer and white bond paper and that legible copies are being produced.

When problems arise with information or lack of it on the order during the pickup stage or upon the start of reproduction, the contractor shall attempt to contact the requester that same day. When the requester cannot be contacted, the contractor shall give the order to the Project Officer for further guidance. When the necessary information cannot be readily obtained, the Project Officer may suggest returning the documents to the PDR and having the contractor note the reason for incompletion on the order form. The contractor shall keep the order form to answer eventual inquiries

L_ regarding it. When the requester neglects to time and L date stamp the request form, the contractor shall time i and date stamp the form-at the time of pickup. The contractor shall look'for special instructions (e.g.,

special delivery or linking of orders) that reflect the type of service to be performed.

In order for the PDR to respond to inquiries from requesters on the status of their orders, the contractor shall maintain a Log Book of all mail The Log Book shall contain the.PDR. assigned letter log number or pre printed form number, the date'the contractor received the order, and the date that the order was mailed / shipped to the requester. A separate Log Book need not be maintained when this' data is already incorporated into the contractor's records which are available at the on-site location. This data..shall be available onsite for quick response to PDR staff and requester inquiries.

C.4 Filling Reproduction Orders To fill a reproduction order the contractor shall:

- Perform the electrical-mechanical reproduction of the documents (See Section'C.2).

C.5 Return of Original Documents to'the PDR Staff Area When orders are filled, the contractor shall return'all PDR folders and microforms to the PDR; for orders filled onsite, all folders and microforms except the contractor's 48X ARMS microfiche, are to be returned on a flow basis during the day as new orders are being picked up from the PDR Reading Room. This is required to ensure that folders and m N roforms are readily available for-requesters seeki g the same or different documents in a given folder or at ai:roform.

When t,rders are filled offsite, PDR folders and microforms shall be returned by the contractor to the onsite locations at the PDR by 8:45 a.m. the following Federal Government workday unless special arrangements are made with the NRC Project Officer based on the volume of the folders and microforms. PDR microforms and aperturc cards shall be returned by the contractor to the onsite location according to the established delivery schedule specified herein.

On a flow ba:1: all folders or individual paper documents that stand alone shall be returned by the -

contractor to the appropriate location in the PDR shelving area and refiled according to established procedures (i.e., remove the "out" card and refile order). Files shall be integrated at no less than a 98 percent accuracy rate. As part of the PDR's quality control procedures, persons refiling documents periodically may be requested to place colored sheets of paper into folders they handle. Occasionally, an onsite requester may supply his copy of a paper document (previously reproduced by the contractor) as a source for additional copies; a note on

.the document will indicate to the contractor the onsite person to whom the documents shall be returned. The contractor will count all folders prior to reshelving and the tally will be listed on the monthly statistics report (Attachment 8). Frequently, the contractor will be given usage survey forms (Attachment 11) which he will complete by noting the number and kind of folders returned to the PDR on the specified day.

C.6 Addressing Inquiries In addition to- other requirements specified hereunder, the contractor shall be available on Federal Government workdays (Monday through Friday from 7:45 a.m. - 4:15 p.m) at th.e onsite location to respond to inquiries and to complete selling transaction for pickup orders. This interaction with the public shall be accomplished in a timely fashion and courteous manner.

The PDR onsite location for the contractor shall be the information point for requesters or-recipients on the status of reproduction orders. Although NRC order forms are provided, not all of the recipients receive copies of these forms because someone else may have filled out the order . form on their behalf. The contractor shall store or identify orders in his possession so as to provide prompt response to queries. The Contractor shall respond to routine inquiries on status of orders within a few minttes.

Altaough several employees may respond to inquiries and resolve problems, it shall be the responsibility of the onsite supervisor to be aware of current problems and

,tatus of resolution. Contractor employees shall observe .

acceptable standards of cordiality and demeanor towards PDR staff and requesters.

(- -Each week for the first four weeks of the contract, the I contractor shall sample a set of orders to determine the delivery time and to review associated tasks for delivering the filled order. The results of this sample shall be verbally discussed with the Project Officer the following week or earlier to resolve or. eliminate problems. For each of the succeeding months of the E

contract period, the Project Officer shall supply to the contractor a sample of orders (no.more than.20) from the previous month. These sample orders' shall be. reviewed by the contractor for analysis against the contract requirements. The contractor shall respond within two weeks to the Projec' Officer with results of this review. The purpose of the sampling is to ensure that management.is aware of actual services rendered to the PDR requester.

Before any form or form letter generated by the contractor is sent or given to the requesters or recipients, a. copy shall be previded to the Project Officer for review for information purposes as well as for potential discrepancies in regards to the requirements of the contract.

Three months before the end of the contract period, the contractor shall supply the Project Officer with a set of pre printed mailing labels in alphabetical order for a minimum of over 90 percent of recipients served during the contract period. The labels must be clear and complete to enable the PDR to notify past recipients of the forthcoming' expiration of the reproduction contract and possible changes in prices.

The contractor shall maintain a file of all filled order forms and shall make this' file available to the NRC Project Officer upon request.

F.4 Filled Reproduction Orders The contractor shall provide the filled order (s) to the recipient or his representative (requester, onsite user, messenger, etc.) as indicated on the order form (s). This includes recipient pickup from the PDR contractor onsite ,

location or through mailing / shipping to the recipient. '

Section G.2 of this solicitation lays out the requirement for a consistent billing policy. The exact procedures for timelv delivery of filled orders will be somewhat dependent .n the billing policy of the Contractor.

However, the overriding requirement for delivery of orders is that it is timely with minimal delay in getting requested documents to the recipient.

In addition, the contractor shall provide a method or methods of billing for pickup orders and for mailed / I shipped orders. For example, the contractor may accept j charge accounts, deposit accounts against which  ;

j requesters may charge future purchases, credit cards, or any other types of billing methods. The method (s) of i I

billing offered by the contractor shall be of the type (s) as to allow the frequent users (onsite or offsite) the option to receive (by pickup, mail or special delivery ,

service) multiple orders without having to submit cash or check (s) in the amount of each individual order. All monthly statements shall reference PDR order numbers l (frorr pre printed forms, letters, standing orders) for each charge to enable the customer to match bills with received orders. Upon award of the resultant contract, the NRC will provide the billing policy and price schedules to current requesters for~ informational purposes.

The contractor may require payment prior to mailing out filled orders as long as the recipient is invoiced or notified (see Section F.6 ) within one Federal Government workday after his order is filled and the filled order is mailed out one Federal Government workday after payment for service is received. The contractor shall mail / ship the order COD when asked by the requester.

The contractor may require requesters without established accounts to provide written confirmation of telephone orders if the dollar amount of the order exceeds $75.00.

G.3 Billing Procedures The prices set forth in Section B shall be the prices billed PDR requesters. These prices shall include handling and materials costs for wrapping in conformance with standard commercial practice to ensure that the filled orders arrive in satisfactory condition.

Applicable sales and use tax (see Section H.9.) will be billed as a separate item.

The contractor shall prepare an invoice accompanying each filled order. The invoice may be a separate form or a stamp placed on each order form and shall provide at a minimum the following information:

TI.e Contractor shall take all reasonable precautions in the performance of the work under this contract to protect the health and safety of employees and of members of the public and to minimize danger from all hazards to life and property and shall comply with all applicable her'th, safety, and fire protection regulations and requirements (including reporting requirements) of the Commission and the Department of Labor. H.3 ORGANIZATIONAL CONFLICTS OF INTEREST (OMB CLEARANCE NUMBER 3150-0112) (JUNE 1988)

a. Purpose. The primary purpose of this clause is to aid in ensuring that the Contractor: ,

1) Is not placed in a conflicting role because of current or planned interests (financial, contractual, organizational, or otherwise) which relate to the work under this contract, and
2) Does not obtain an unfair competitive advantage over other parties by virtue of its performance of this contract.
b. Scope. The restrictions described apply to performance or l participation by the Contractor as defined in 48 CFR 2009.570-2 in

! the activities covered by this clause.

I c. Work for others. Notwithstanding any other provision of this contract, during the term of this contract, the Contractor

agrees to. forgo entering into consulting or other contractual arrangements with any firm or organization, the result of which may give rise to a conflict of interest with respect to the work being

If the Contractor believes with respect to itself or any employee that any proposed consultant or other contractual arrangement with any firm or organization may involve a potential conflict of interest, the Contractor shall obtain the written approval of the Contracting Officer prior to execution of such contractual arrangement.

, d. Disclosure after award.

1) The Contractor warrants to the best of its knowledge and belief, and es. cept as otherwise set forth in this contract, that it Ldoes not have any organizational conflicts of interest, as ac'ined in 48 CFR 2009.570-2.
2) The Contractor agrees that, if after award, it discovers organizational conflicts of interest with respect to this contract, it shall make an immediate and full disclosure in writing to the Contracting Officer. This statement must include a description of the action which the Contractor has taken or proposes to take to avoid'or mitigate such conflicts. The NRC may, however, terminate the' contract if termination is in the best interest of the Government. ,
e. Access to and use of information.
1) If the Contracter in the performance of this contract obtains access to information, such as NRC plans, policias, reports, studies, financial plans, internal data protected by the Privacy Act of 1974 (Pub. L.93-579), or data which has not been released to the public, the Contractor agrees not to: .

(i) Use this information for any private purpose until the information has been released to the public; (ii) Compete for work for the Commission based on the information for a period of six (6) months after either the completion of this contract or the release of the information to the public, whichever is first; I

(iii) Submit an unsolicited proposal to the Government based on the information until one year after the release of the information to the public, or ,

(iv) Release the information without prior written approval by the Contracting Officer unless the information has previously been released to the public by the NRC.

2) In addition, the Contractor agrees that to the extent it receives or is given access to p,*oprietary data, data protected by the Privacy Act of 974 (Pub. L.93-579), or other confidential or .

privileged technical, business, or financial information under this contract, the Contractor shall treat the information in accordance with restrictions placed on use of the information.

3) The Contractor shall have, subject to patent and security provisions of this contract, the right to use technical data it produces under this contract for private purposes provided that all requirements of this contract have been met.
f. Subcontracts. Except as provided in 48 CFR 2009.570-2(g),  !

the Contractor shall include this clause, including this paragraph, I in subcontracts of any tier. The terms " contract," " Contractor,"

and " Contracting Officer," must be appropriately modified to preserve the Government's rights.

g. Remedies. For breach of any of the above restrictions or for intentional nondisclosure or misrepresentat:on of any relevant interest required to be disclosed concerning this contract or for such erroneous representations that necessarily imply bad faith, the Government may terminate the contract for default, disqualify the Contractor from subsequent contractual efforts, and pursue other remedies permitted by law or this contract,
b. Waiver. A request for waiver under this clause must be directed in writing through the Contracting Officer to the Executive Director for Operations (E00) in accordance with the procedures outlined in 48 CFR 2009.570-9.

, H.6.1 Onsit2/ Paper to Paper The contractor shall install, maintain and operate.at the PDR onsite location, a minimum of one high-speed electrostatic copying machine with automatic feed and reduction capabilities. An additional manned

electrostatic copying machine may be installed and

' operated by the contractor to meet the delivery schedule established in the contract. With extended building hours available, the contractor is encouraged to perform as much paper to paper copying onsite as.possible to elimi-nate the problems that develop with offsite processing.

H 6.2 Onsite/ Microfiche to Paper l The contractor shall install three or more microfici e printer (s) to provide white bond paper blowbacks.

H.6.3 Onsite/ Microfiche to Microfiche The contractor has the option to install a table model microfiche duplicating machine onsite to meet the delivery schedule established in the contract. There is no vent to the outside from this room.

H.6.4 Onsite/ Coin-Operated Equipment The contractor shall also install and maintain one self-service coin-operated electrostatic copying machine in the Public Reading Room, PDR, that can reproduce both 8-1/2" x 11" and 8-1/2" x 14" sized documents. When the coin-operated machine requires more than two service calls a month (excluding preventive maintenance) the Government may consider it as nonoperable with a need for replacement. Contractor personnel shall monitor the operation of the machine in terms of an ample supply of paper and toner and that legible copies are being -

produced.

H.6.5 ARMS Microfiche Collection The Project Officer, usually on a daily basis, will give the contractor two sets of approximately 20 new ARMS microfiche each in sequential number order in individual envelopes. The contractor shall mark the upper right hand corner of the microfiche with permanent marking pens to ensure that these microforms do not become intermixed with the 48X ARMS microfiche stored elsewhere at the PDR. The contractor shall use different colored pens (orange and purple) to mark each set. The contractor shall then sequentially file the microfiche into the cabinets in his area.

The contractor shall be responsible for furnishing sufficient quantities of toner / developer, bond paper, -

paper clips, film, collating bins, carts to transport documents, a telephone, a time and date stamp machine, a device for cutting spine bindings off PDR documents (when approved by the PDR staff) large and small staplers with staples, staple remover, pliers for the larger staples, rubber bands, microfiche envelopes, items to process the financial transactions, colored marking pens for microfiche, sufficient shelving at the onsite location and all other equipment and supplies that are necessary for providing reproduction and reinted services for the public at the PDR.

H.6.7 Contractor provided Property and Manpower for Offsite Reproduction and Related Services The contractor shall have the necessary resources and equipment available for offsite reproduction of all types of services specified in Section C required for compliance with delivery schedules in Section F. The  ;

contractor shall be responsible for all film, paper, '

property, equipment, transportation, and all other supplies as required to provide reproduction and related services at the offsite facility.

The contractor shall arrange for at least one pickup each day, or however many as may be required to meet the ,

specified delivery schedules of requester orders for paper, blowback, and microform reproduction services. .

Orders to be taken offsite are to be picked up at the PDR '

onsite contractor facility from onsite personnel who

. shall be responsible for gathering orders from a pickup area in the Public Reading Room during the course of the Federal Government workday.

H.6.8 Manpower A minimum of two persons (one the on-site supervisor) shall be on duty at all times at the PDR onsite contractor facility during each PDR workday f- . 7:45 a.m. to 4:15 p.m. Monday through Friday. Additional personnel are to be provided by the contractor on an as-needed basis to meet the delivery schedule established in this contract for all activities to provide filled reproduction orders to the requesters or to answer

! inquiries on the status of documents. The onsite location shall be kept neat and orderly at all times. In the event that work is done at the on-site location outside of regular PDR hours, there shall be a supervisor l

present if more than one contractor employee is on-site. ,

H.7 Contractor Backup Equipment If at any time during the performance of work under this contract, contractor installed onsite equipment fails to operate,.the contractor shall immediately place a' service call for repair of the equipment, and make every attempt to have the machine operable as quickly as possible.

When the volume of orders increases to such an extent that the contractor cannot meet the delivery schedule during normal business hours, the contractor shall notify the NRC Project Officer. The contractor shall use the necessary backup equipment to complete the outstanding orders.

H.8 Equipment Removal The contractor shall remove all contractor onsite property / supplies from the PDR within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> after expiration of the contract. The NRC will notify the contractor at least 14 calendar days prior to expiration of the contract so that the contractor may make arrange-ments for removal of his equipment and supplies. H.9 Federal, State and Local Taxes The contractor is responsible for the payment of all Federal, state and local taxes which taxing authorities impose and collect on the sales of copies and services covered by this contract. Section 47-2001n(1)(J) of the District of Columbia code states that the terms " retail sale" and " sale at retail" include the sale or charges for copying, photocopying, reproducing, duplicating, addressing and mailing services for purposes of the Gross Sales Tax. Section 47-2026 requires vendors to obtain a certificate of registration, and Section 47-2009 requires the amount of the tax to be stated and charged separately from the sales price and shown separately on any record thereof at the time the sale is made or evidence of sale issued by the vendor. The contractor is required to familiarize himself with other relevant provisions of the Gross Sales. tax, including its application to sales when  ;

copies are mailed outside the District of Columbia and to l sales when copies are reproduced on coin-operated copying machines.

H.10 Government Provided Property The NRC shall provide to the contractor, for use in connection with the performance of this contract, the following:

3 (1) Sufficient space for a maximum of two contractor copying machines, one contractor desk top microfiche duplicating machine, and three contractor microfiche printers to be located at the onsite location of the PDR, 2120 L Street, N.W., Lower Level 1, Washington, D.C. There is approximately 750-feet of floor space in this room. (See Attachment 9.) There is no vent or window for outside air. The building is open from 7:00 am to 6:00 pm each PDR workday. The contractor will have key card access outside of these hours. Sufficient space in the PDR Public Reading Room exists for one contractor provided self-service, coin-operated, copying machine.

(2) Electricity. Five 220-volt 30-amp outlets and sixteen 110/120-volt outlets and electricity -

necessary at the onsite facility. One 110/120 volt outlet and electricity necessary for operation of the self-service coin-operated machine located in the PDR Reading Room.

(3) Furniture. One desk, three tables, six chairs, one rolling table, one stool, and four microfiche cabinets.

(4) Order Forms. NRC reproduction order forms for all types of reproduction services.

(5) Folder repair supplies. Sufficent supply of Ames Easiclip bar's, U-clips, and replacement tubing.

(6) Microfiche collection. Two complete set of 48X ARMS microfiche representing currently about 37,000 microfiche each in sequential order by microfiche number. The government shall provide microfiche cabinets for the storage of this collection.

(7) Training. Initial training will be conducted for filing the 48X ARMS microfiche at the contractor's onsite facility and for refiling folders in the PDR shelving area. The placement of auditing sheets within folders may be required from time to time as necessary to check accuracy of refiling.

!.4 SERVICE CONTRACT ACT OF 1965 (I-FSS-222-41) (APR 1984) j (a) Service Contract Act of 1965, as amended: This contract is subject to the Service Contract Act of 1965, as amended (41 U.S.C.

351 et seq.) and is subject to the following provisions and to all other spplic;ble ,rovisions n of the Act and regulations of the 1 Secretary of Labor issued thereunder (29 CFR Part 4).

(b)(1) Each service employee employed in the performance of this contract by the Contractor or any subcontractor shall be paid not less than the minimum monetary wages and shall be furnished fringe benefits in accordance with the wages and fringe benefits 1 determined by the Secretary of Labor or authorized representative, as specified in any wage determination attached to this contract.

(2)(1) If there is such a wage determination attached to this contract, the contracting officer shall require that any class of service employee which is not listed therein and which is to be employed under the contract (i.e., the work to be performed is not performed by any classifications listed in the wage determination),

be classified by the Contractor so as to provide a reasonable relationship (i.e. , appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination. Such conformed class of employees shall be paid the monetary wages and furnished the fringe ber . fits as are determined pursuant to the procedures in this section. (The

.information collection requirements contained in the following paragraphs of this section have been approved by the Office of Management and Budget under OMB control number 1215-0150.) -

(ii) Such conforming procedure shall be initiated by the Contractor prior to the performance of contract work by such unlisted class of employee. A written report of the proposed conforming action, including information regarding the agreement or disagreement of the authorized representative of the employees involved or, where there :s no authorized representative, the employees themselves, shall be submitted by the Contractor to the contracting officer no later than 30 days after such unlisted class of employees performs any contract work. The contracting officer shall review the proposed action and prompt:y submit a report of the action, together with the agency's recommendation and all pertinent information including the position of the Contractor and the ,

employees, to the Wage and Hour Division, Employment Standards Administration, U.S. Department of Labor, for review. The Wage and Hour Division will approve, modify, or disapprove the action or render a final determination in the event of disagreement within 30 days of receipt or will notify the contracting officer within 30 days of receipt that additional time is necessary.

(iii) The final determination of the conformance action by the Wage and Hour Division shall be transmitted to the contracting officer who shall promptly notify the Contractor of the action taken. Each affected employee shall be furnished by the Contractor with a written copy of such determination or it shall be posted as a part of the wage determination.

(iv)(A) The process of establishing wage and fringe benefit rates that bear a reasonable relationship to those listed in a wage determination cannot be reduced to any single formula. The approach 1 used may vary from wage determination to wage determination l depending on the circumstances. Standard wage and salary administration practices which rank various job classifications by pay grade pursuant to point schemes or other job factors may, for example, be relied upon. Guidance may also be obtained from the way different jobs are rated under Federal pay systems (Federal Wage l Board Pay System and the General Schedule) or from other wage i determinations issued in the same locality. Basic to the I establishment of any conformable wage rate (s) is the concept that a pay relationship should be maintained between job classifications based on the skill required and the duties performed.

(B) In the case of a contract modification, an exercise of an option or extension of an existing contract, or in any other case where a Contractor succeeds a contract under which the classification in question was previously conformed pursuant to this section, a .ww conformed wage rate and fringe benefits may be assigned to s'Jch conformed classification by indexing (i.e.,

adjusting) the previous conformed rate and fringe benefits by an amount equal to the average (mean) percentage increase (or decrease, where appropriate) between the wages and fringe benefits specified for all classifications to be used on the contracts which are listed

- in the current wage determination., and those specified for the corresponding classifications in the previously applicable wage determination. Where conforming actions are accomplished in accordance with this paragraph prior to the pcc Demance of contract work but the unlisted class of employees, the Contractor shall advise the contracting officer of the action taken by the other procedures in paragraph (b)(2)(ii) of this section need not be followed.

(C) No employee engaged in performing work on this contract shall in any event be paid less than the currently applicable minimum wage specified under section 6(a)(1) of the Fair Labor Standards Act of 1938, as amended.

(v) The wage rate and fringe benefits finally determined pursuant to paragraphs (b)(2)(1) and (ii) of this section shall be paid to all employees performing in the classification from the first day on which contract work is performed by them in the classification. Failure to pay such unlisted employees the compensation agreed upon by the interested parties and/re finally determined by the Wage and Hour Division retroactive to the date such class of employeer, commenced contract work shall be a violation of the Act and this contract.

(vi) Upon discovery of failure to comply with paragraphs (b) (2)(1) through (v) of this section, the Wage and Hour Division shall make a final determination of conformed classification, wage L___________.._

(c) The Contractor or subcontractor may discharge the obligation to furnish fringe benefits specified in the attachment of determined conformable thereto by furnishing any equivalent combinations of bona fide fringe benefits, or by making equivalent or differential payments in cash in accordance with the applicable rules set forth in Subpart D of 29 CFR Part 4, and not otherwise.

(d)(1) In the absence of a minimum wage attachment for this contract, neither the Contractor nor any subcontractor under this contract shall pay any person performing work under the contract (regardlest of whether they are service employees) less than the minimum wage specified by section 6(a)(1) of the Fair Labor Standards Act of 1938. Nothing in this provision shall relieve the Contractor or any subcontractor of any other obligation under law or contract for the payment of a higher wage to any' employee.

Service Contract Act of 1965 as amended, under which substantially the same amended, under which substantially the same services were furnished in the same locality and service employees were paid wages and fringe benefits provided for in a collective bargaining agreement, in the absence of the minimum wage attachment for this contract setting forth such collectively bargained wage rates and fringe benefits, neither the Contractor nor any subcontractor under this contract shall pay any service employee performing any of the contract work (regardless of wnether or not such employee was employed under the predecessor contract), less than the wages and fringe benefits provided for in such collective bargaining agreements, to which such employee would have been entitled if employed under the predecessor contract, including accrued wages and fringe benefits and any prospective increases in wages and fringe benefits provided for under such agreement. No Contractor or subcontractor under this contract may be relieved of the foregoing obligation unless the limitations of Section 4.lb(b) of 29 CFR Part 4 apply or unless the Secretary of Labor or his authorized representative finds, after a hearing as provided in Section 4.10 of 29 CFR Part 4 that the wages and/or fringe benefits provided services of a character similar in the locality, or determines, as provided in Section 4.11 of 29 CFR Part 4, that the collective bargaining agreement applicable to service employees employed under the predecessor contract was not entered into as a result of arm's length negotiations. and 8 that some.or all of the wages and/or fringe benefits contained in a predecessor Contractor's collective bargaining agreement are substantially at variance with those which prevail for services of a character similar in the locality, and/or that the collective bargaining agreement applicable to service employees employed under the. predecessor contract was not entered into as a result of arm's length negotiations, the Department will issue a new or revised wage determination setting forth the applicable wage rates and fringe benefits. Such determination shall be made part of the contract or subcontract, in accordance with the decision of the Administrator, the Administrative Law Judge, or the Board of Service Contract Appeals as the case may be, irrespective of whether such issuance occurs prior to or after the award of a contract or subcontract 53 Comp. Gen. 401 (1973). In the case of a wage determination issued solely.as a result of a finding of substantial variance, such determination shall be effective as of the date of the final administrative decision.

(e) The Contractor and any subcontractor under this contract shall notify each service employee commencing work on this contract of the minimum monetary wage and any fringe benefits required to be paid pursuant to this contract, or shall post the wye determination attached to this contract. The poster provided by the Department of Labor (Publication WH 1313) shall be posted in a prominent and accessible place at the worksite. Failure to comply with this requirement is a violation of section 2(a)(4) of the Act and of this contract. (Approved by.the Office of Management and Budget under OMB control number 1215- 0150.)

(f) The Contractor or subcontractor shall not permit any part of the services called for by this contract to be performed in building or surroundings or under working conditions provided by or under the control or supervision of the Contractor or subcontractor which are unsanitary or hazardous or dangerous to the health or safety of service employees engaged to furnish these services, and the Contractor or subcontractor shall comply with the safety and l health standards applied under 29 CFR Part 1925. ~

completion of the work records containing the information specified in paragraphs (g)(1) (i) through (vi) of this section for each cmployee subject to the Act and shall make them available for inspection and transcription by authorized representatives of the )

Wage and Hour Division, Employment Standards Administration of the l U.S. Department of Labor. (Sections 4.6(g)(1)(1) through (vi) l appreved by the Office of Management and Budget under OMB control number 1215-0017 and sections 4.6(g)(1)(v) and (vi) approved under OMB control number 1215-0150.):

(i) Name and address and social security number of each ,

employee.

r (ii) The correct work classification or c' classification, l' rate or rates of monetary wages paid and fringe benefits provided,

(iii) The number of daily and weekly hours so worked by each employee.

(iv) Any deductions, rebates, or refunds from the total daily or weekly compensation of each employee.

(v) A list of monetary wages and fringe benefits for those classes of service employees not .ncluded in the wage determination attached to this contract but for which such wage rates or fringe benefits have been determined by the interested parties or by the Administrator or authorized representative pursuant to the labor standards clause in paragraph (b) of this section. A copy of the report required by the clause in paragraph (b)(2)(ii) of this section shall be deemed to be such a list.

(vi) Any list of the predecessor Contractor's employees which had been furnished to the Contractor pursuant to Section 4.6(1)(2).

(2) The Contractor shall also make available a copy of this contract for inspection or transcription by authorized representatives of the Wage and Hour Division.

(3) Failure to make and maintain or to make available such records for inspection and transcription shall be a violation of the regulations'and this contract, and in the case of failure to produce such records, the contracting officer, upon direction of the Department of Labor and notification of the Contractor, shall take action to cause suspension of any further payment of advance of funds until such violation ceases.

(4) The Contractor shall permit authorized representatives of the Wage and Hour Division to conduct interviews with employees at the worksite during normal working hours.

(h) The Contractor shall unconditionally pay to each employee ,

subject to the Act all wages due free and clear and without subsequent deduction (except as otherwise provided by law or Regulations, 29 CFR Part 4), rebate, or kickback on any account.

Such payments shall be made no later than one pay period following the end of the regular pay period in which such wages were earned or accured. A pay period under this Act may not be of any duration longer than semi-monthly.

(i) The contracting officer shall withhold or cause to be withheld from the Government prime Contractor under this or any other Government contract with the prime Contractor such sums as an appropriate official of the Department of Labor requests or such sums as the contracting officer decides may be necessary to pay underpaid employees employed by the Contractor or subcontractor in the event of failure to pay any employees subject to the Act all or part of the wages or fringe benefits due tnder the Act, the agency

l may,'after' authorization or by direction of .he Department of Labor-and written notification to the Contractor, ake action to cause suspension of any further payment or advance of funds until such violations have ceased. Additionally, any f111ure to comply with the requirements of these clauses relating i> the Service Contract Act of 1965, may be grounds for termination )f the right to proceed with the contract work. In such event, the lovernment may enter into other contracts or arrangements for completion of the work, charging the Contractor in default with any additional cost.

(j) The Contractor agrees to insert these clauses in this section relating to the Service Contract Act of 1965 in all subcontracts subject to the Act. The term " Contractor" as tised in these clauses in any subcontract, shall be deemed to refer to the subcontractor, except in the term " Government prime Contractor."

(k)(1) As used in these clauses, the term " service employee" means any person engaged in the performance of this contract other than any person employed in a bona fide executive, administrative, or professional capacity, as.those terms are defined in Part 541 of Title 29, Code of Federal Regulations, as of July 30, 1976, and any subsequent revision of those regulations. The term " service i employee" includes all such persons regardless of any contractual relationship that may be alleged to exist between a Contractor or subcontractor and such persons.

(2) The following statement is included in contracts pursuant to section 2(a)(5) of the Act and is for informational purposes only: The following classes of service employees expected to be employed under the contract with the Government would be subject, if employed by the contracting agency, to the provisions of 5 U.S.C.

5341 or 5 U.S.C. 5332 and would, if so employed, be paid not less than the following rates of wages and fringe benefits:

RS-SEC-89-120 Section I (2) Not less than 10 days prior to completion of any contract being performed at a Federal facility where service employees may be retained in the performance of the succeeding contract and subject to a wage determination which contains vacation or other benefit provisions based upon length of service with a Contractor (predecessor) or successor (Section 4.173 of Regulations 29 CFR Part l 4), the incumbent prime Contractor shall furnish to the contracting officer a certified list of the names of all service employees on the Contractor's or subcontractor's payroll during the last month of cor, tract performance. Such. list 'shall also contain anniversary dates of employment on the contract either with the current or predecessor Contractors of each such m vice employee. The contracting officer shall turn over such list to the successor Contractor at the commencement of the succeeding contract. (Approved by the Office of Management and Budget under OMB control number 1215-0150.)

(m) Rulings and interpretations of the Service Contract Act of 1965, as amended, are contained.in Regulations, 29 CFR Part 4.

(n)(1) By entering into this contract, the Contractor (and officials thereof) certifies that neither it (nor he or_ she) nor any person or firm who has a substantial interest in the Contractor's firm is a person or firm ineligible to be awarded Government contracts by virtue of the sanctions imposed pursuant to section 5 of the Act.

(2) No part of this contract shall be subcontracted to any person or firm ineligible'for award of a Government contract *

  • pursuant to section 5 of the Act.

(3) The penalty for making false statements is prescribed in the U.S. Criminal Code, 18 U.S.C. 1001.

(o) Notwithstanding any of the clauses in paragraphs (b) through (m) of this section relating to the Service Contract Act of 1965, the following employees may be employed in accordance with the j following variations, tolerances, and exemptions, which the Secretary of Labor, pursuant to section 4(h) of the Act prior to its amendment by Pub. L.92-473, found to be ne.essary and proper in the public interest or to avoid serious impairme.t of the conduct of Government business:

(1) Apprentices, student-learners, and w.ckers whose earning capacity is impaired by age, physical, or mental deficiency or injury may be employed at wages lower than the minimum wages otherwise required by section 2(a)(1) or 2(b)(1) of the Service Contract Act without diminishing any fringe benefits or cash payments in lieu thereof required under section 2(a)(2) of that Act, in accordance with the conditions and procedures prescribed for the employment of apprentices , student-learners, handicapped persons,  ;

and handicapped clients of sheltered workshops under section 14 of j the Fair Labor Standards Act of 1938, in the regulations issued by i the Administrator (29 CFR Parts 520, 521, 524, and 525).

(2) The Administrator will issue certificates under the Service Contract Act for the employment of apprentices, student-learners, handicapped persons, or handicapped clients of sheltered workshops'not subject to the Fair Labor Standards Act of ,

1938, or subject to different minimum rates of pay under the two i acts, authorizing appropriate rates of minimum wages (but without changing requirements concerning fringe benefits or supplementary cash payments in lieu thereof), applying procedures prescribed by I the applicable regulations issued under the Fair Labor Standards Act of 1938 (29 CFR Parts 520, 521, 524, and 525).

(3) The Administrator will also withdraw, annul, or cancel such certificates in accordance with the regulations in Parts 525 and 528 of Title 29 of the Code of Federal Regulations.

(p) Apprentices will be permitted to work at less than the predetermined rate for the werk they perform when they are employed and individually registered in a bona fide apprenticeship program registered with a State Apprenticeship Agency which is recognized by the U.S. Department of Labor, or if no such recognized agency exists in a State, under a program registered with the Bureau of Apprenticeship and Training, Employment and Training Administration, U.S. Department of Labor. Any employee who is not registered as an apprentice in a,n approved program shall be paid the i wage rate and fringe benefits contained in the applicable wage determination for the journeyman classification of work actually performed. The wage rates paid apprentices shall not be less than the ' wage rate for their level of progress set forth in the

  • registered program, expressed as the appropriate percentage of the journeyman's rate contained in the applicable wage determination.

The allowable ratio of apprentices to journeymen employed on the contract work in any craft classification shall not be greater than the ratio permitted to the Contractor as to his entire work force under the registered program.

(q) An employee engcged in an occupation in which he or she customarily and regularly receives more than $30 a month in tips may have the amount of tips credited by the employer against the minimum wage required by section 2(a)(1) or section 2(b)(1) of the Act in accordance with section 3(m) of the Fair Labor Standards Act and Regulations, 29 CFR Part 531: Provided, however, that the amount of such credit may not exceed S1.24 per hour beginning January 1, 1980,

.and $1.34 per hour after December 31, 1980. To utilize this provision:

(1) The employer must inform tipped employees about this tip credit allowance before the credit is utilized; (2) The employees must be allowed to retain all tips l (individually or through a pooling arrangement and regardless of whether the employer elects to take a credit for tips received);

(3) The employer must be able to show by records that the employee receives at least the applicable Service Contract Act l minimum wage through the combination of direct wages and tip credit; '

(4) The use of such tip credit must have been permitted under any predecessor collective bargaining agreement applicable by virtue l of section 4(c) of the Act.

-(r) Disputes concerning labor standards. Disputes arising out of the labor standards provisions of this contract shall not be subject to the general disputes clause of this contract. Such.

disputes shall be resolved in accordance with the procedures of the Department of Labor. set forth in 29 CFR Parts 4, 6, and 8. Disputes i within the meaning of this clause include disputes between the Contractor (or any of its f. subcontractors) and the contracting agency, the U.S. Department of Labor, or the employees or their representatives.

I.5 DRUG-FREE WORKPLACE (FAR 52.223-6)

(a) Definitions. As used in this clause,

" Controlled substance" means a controlled substance in schedules I through V of section 202 of the Controlled Substances Act (21 U.S.C. 812).and as further defined in regulation at 21 CFR 1308.11-1308.15.

" Conviction" means a finding of guilt (including a plea of nolo contendere) or imposition of sentence, or both, by any judicial body charged with the responsibility to determine violations of the Federal or State criminal drug statutes. }

" Criminal drug statute" means a Federal or non-Federal criminal statute involving the manufacture, distribution, dispensing, possession or use of any controlled substance.

" Drug-free workplace" means a site for the performance of work j done in connection with a specific contract at which employees of )

the contractor are prohibited from engaging in the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance.

" Employee" means an employee of a contractor directly engaged in the performance of work under a Government contract.

" Individual" means an offeror / contractor that has no more than one employee including the offeror / contractor.

(b) The Contractor, if other than an individual, shall --

0 ) Publish a statement notifying its employees that the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance is prohibited in the contractor's workplace and specifying the actions that will be taken against employees for

t violations 'of such prohibition; (2) Establish a drug-free awareness program to' inform such 4 employees about-- -

(1).The dangers of drug abuse in the workplace;

.(ii) The contractor's policy of maintaining a drug-free workplace; (iii) Any available drug counseling, rehabilitation, and employee assistance programs; and (iv) The penalties that may be imposed upon employees for drug abuse violations occurring in the workplace.

(3) provide all employees engaged in performa1ce of the contract .;

with a copy of the statement required by subparagraph (b)(1).of this  ;

clause; (4) Notify such employees in the statement required by '

subparagraph (b)(1) of this clause, that as a condition of continued employment on this contract, the employee will --

(i) Abide.by the terms of the statement; and (ii) Notify'the employer of any criminal drug natute conviction for a violation occurring in the workplace no later than five (5) days after such conviction.

(5) Notify the contracting officer within ten (10) days after receiving notice under subdivision (a)(4)(ii) of this clause, from an employee or otherwise receiving actual notice of such conviction; (6) Within 30 days after receiving notice under subparagraph (a)(4) of this clause of a convictien, impose the following sanctions or remedial measures on any employee who is convicted of drug abuse violations occurring in the workplace:

(1) Taking appropriate personnel action against such employee, up to and including termination; or (ii) Require such employee to satisfactorily participate in a drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State, or local health, law enforcement, or other appropriate agency.

(7) Make a good faith effort to maintain a drug-free workplace j through implementation of subparagraphs (b)(1) through (b)(6) of

, this clause.

(c) The Contractor, if an individual, agrees by award of the contract or acceptance of a purchase order, not to engage in the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance in the performance of this contract. .
