IMPOSITION OF CIVIL PENALTY - $2,C00 By EN 89-32 dated March 17, 1989 the Connission was notified of the intent of OE I to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the i amount of Two Thousand Five Hundred Dollars ($2,500) to The Defense Nuclear ('
Agency. This action was based on a number of violations involving (1) failure to perform written safety evaluations, (2) procedure adherence problems, (3) failure to ensure all operators satisfactorily completed the requalification training program, and (4) discrimination in violation of 10 CFR 50.7, against ar. employee who raised safety concerns.
The licensee responded to the Notice in a letter dated May 4, 1989 admitting a number of violations, but denying others, most notability the 10 CFR 50.7 violation. After careful consideration of the licensee's response, the staff '
has concluded that all of the violations occurred as set fcrth in the Notice of Violation and Proposed Imposition of Civil Fenalty and that mitigation was not warranted.
Accordingly, an Order Imposing Civil Penalty in the amount of 52,500 has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
