WITHDRAWAL OF PROPOSED CIVIL PENALTY, By EN 89-29 dated March 14, 1989 the Commission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty.in the.cmount.of Fif ty Thousand Dollars ($50,000) to Houston Lighting and Power Compar1y. Thfs action was. based on_a violation involving the licensee's failure to install prior to plant licensing in 1988, the. vortex suppressors in the emergency pumps which supply the suction for the safety injection and contain-ment spray. pumps in the recirculation mode.

The licensee responded to the Notice in a letter dated April 12, 1989. After careful. consideration of the licensee's' response, the staff has concluded that the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty. However, the original proposed civil penalty has been withdrawn after considering the licensee's arguments for mitigation.

Accordingly, in a letter dated today the licensee is being informed of the' staff's decision.
