SUBJECT:
ALLEGATION CONCERNING FORT ST. VRAIN On September 26, 1986, I received a telephone call from James Sutton, who was a reactor inspector with Region IV, NRC, until he retired on July 4, 1984.
Sutton called to relay his concern about the operation of Fort St. Vrain.
Sutton reported that he had received information which indicated that Fort St.
Vrain was not able to achieve a safe shutdown because of the inability of the steam generators to adequately handle the flow of water needed to cool down the reactor from 100% power.
Sutton claimed that the NRC' staff was aware of the problem, yet it allowed the reactor to operate for two months (April and May 1986).
Sutton further asserted that the staff was not interested in correcting the problem, which according to Sutton could not be corrected, but instead was only interested in developing calculations to justify operating Fort St. Vrain with the deficient generators, t

May 14 I985 Report of Interview OIA CS S-2 was interviewed telephonically regarding his confidentiality agreement with DRISKILL.
He stated essentially as follows:

1/26/85 Reviewed memo and attached testimony of Mouser. Information alleces that Driskill provided confidential information to the applicant. There is no indication that Driskill violated the confidentiality of any confidential source. Because NRC policy is to protect the identity of the source of information and not the information itself, there is nothing to indicate that Driskill's actions were improper. Consequently, there is no basis for an OIA investigation.
Prepared memo to Deputy Director recommending this matter be closed in the files of this office.
