APPENDIX A NOTICE OF VIOLATION i

Combustion Engineering, Inc. Docket No. 70-1100 i Windsor, Connecticut License No. SNM-1067 During an inspection conducted on March 13-17, 1989, violations of NRC requirements  !

were identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (Enforcement Policy, 1988), the violation is set forth below. ,

A. Amendment No. 9 to License No. SNM-1067 dated April 8,1987 incorporates Section 2.7.2 " Operating Procedures", dated October 22, 1986, into the NRC-approved licensee application (Part 1 - Criteria) which states, in part, that it shall be the responsibility of the Plant Manager (NFM) to assure that all operations involving radioactive materials have written procedures which include the appropriate safety requirements and are followed.

Contrary to the above, on March 13-14, 1989, the Plant Manager (NFM) did not assure that:

(1) all of the requirements of a Radiation Work Permit, written in lieu of an operation procedure for an enrichment cleanup (an operation involving radioactive materials), were followed in that an operator did not use (close) a Plexiglas door on the belt drier to minimize airborne activity while striking the outside surface of the drier hood with a mallet to dislodge powder adhered to the inner surface, and; i

(2) all operations involving radioactive materials have written pro- I cedures in that there was no written procedure to cover the dilution ,

of liquid waste of all applicable concentrations in excess of a 7:1 l 6Mution ratio prior to release of the liquid to the environment.

Liquid wastes up to a ratio of 15:1 were identified by analysis on or about January 3, 1989.

This is a Severity Level IV Violation in the aggregate (Supplement VI D).

Pursuant to the provisions of 10 CFR 2.201, Combustion Engineering, is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; i (2) corrective steps which will be taken to avoid further violations; and 1 (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
