It should be understood by all concerned that these agreements will be subject to further discussion amongst the parties, and evaluation in light of experience.

In this regard, it is also understood that the parties will meet periodically for sty:h discussion and evaluation.

c a POINTS OF AGREEMENT NRC STAFF, CASE, TU ELECTRIC MEETING MAnt'N 8, 1999 During the course of tho March 8, 1989 meeting among I the NRC Staff, CASE, and TU Electric, the following points of agreement were reached:

1. A TU/NRC or CASE /NRC interaction shall be considered

a meeting and shall be noticed under the Stipulation ]

q if it would require significant advance preparation and a presentation on the part of TU or CASE.

Interactions between CASE management (Mrs. Juanita Ellis or Billie Garde or designated CASE management representatives) and NRC management or a few TU managers and NRC management that.do not require such advance preparation or involve the presentation of results are considered management interactions that are TU's and CAS5's respective prerogatives.

These prerogatives are unaffected by the Stipula-tion. Interactions between NRC inspectors or reviewers and TU technical people for the purpose of NRC's gathering of facts in pursuit of its inspec-tion function are considered technical interactions, that are likewise unaffected by the Stipulation.

2. If NRC inspectors or reviewers intend to hold exit meetings with TU following their on-site inspection

2-or' review activities, this will be declared at the

'beginning of these activities. If during;the course of any activities.NRC inspectors or reviewers decide to conduct an exit meeting which has not been previously declared, they will notify TU Electric.

3. CASE's' position on allegations management'can be summarized as follows:

If CASE receives CPSES worker allegations of discriminatory conduct and/or substantive technical, engineering, or quality problems at CPSES,_ CASE will first advise the individual of his/her rights under applicable' employment. law and refer him/her to a lawyer and. encourage him/her'to pursue his/her concerns through one 1

of several avenues. Neither CASE nor Billie ]

Garde intends to represent such individuals in a

discrimination cases or lawsuits in connection with CPSES. CASE will also initially offer to address the merits of the substantive allega-tions or concerns about the plant and explain to the individual the avenues available to CASE l for pursuing allegations under the terms of the Joint Stipulation. This includes pursuing iM_a-__________ _

c issues through the monitoring project without the benefits of the worker's assintance or by referring them to TU Electric SAFETEAM, Security, QA Department, etc., and reviewing TU's resolution under the terms of.the Stipula-tion. If the worker is concerned about con-fidentiality, CASE will also advise the worker that he/she can handle the matter independently in one of two ways: (1) he or she can bring it to the attention of SAFETEAM, or (2) he or she can bring it directly to the NRC.

In the case of wrongdoing allegations, CASE will proceed in accordance with the above approach; provided that if CASE believes that the particular circumstances of a particular allegation so warrant, CASE will advise the worker to take those issues directly to the NRC's Office of Investigations or CASE will exercise its prerogative under the Stipulation to bring that allegation directly to the NRC Office of Investigations.

4. . CASE concerns will be handled as follows:

a. In general, CASE will first present its con-carna about any practice, procedure, action, or event in connection with CPSES to TU. If CASE intends to present'the matter directly to.the.

NRC Staff with the expectation of NRC action, CASE management or CASE representatives expressly authorized by CASE management will expressly advise NRC of that intent. Unless it is so_ advised, the Staff can properly presume tnat the concern is not presented to it for resolution..

b. The Staff will" advise TU to keep it informed concerning resolution of the concern.
c. If the Staff chooses, it may examine the concern through its independent means.
d. If CASE brings a concern directly to the NRC l Staff (other than a concern covered by l

l paragraph 3 above) the Staff will advise CASE that, if CASE believes the concern to be worthy of pursuit, CASE should take it to TU for resolution.
