Proposed Amendment to Vermont Yankee Operating License to Extend the License Expiration to 40 Years from Date of Issuance By [[letter::05000271/LER-1989-017, :on 890330,svc Water Check Valves Inoperable Due to Corrosion of Internal Parts.Check Valve Cleaned & Returned to Svc.Review of All Svc Water Sys Check Valve Performance Conducted|letter dated April 27, 1989]] [ Reference d)], Vermont Yankee submitted a proposed amendment request for Operating License DPR-28 to extend the date of license expiration to 40 years from the issuance date of the full-term operating license. The purpose of this letter is to revise the license expiration date specified in the subject proposed license amendment change submittal.

The current expiration date for the Vermont Yankee operating license is December 11, 2007, reflecting a period of 40 years from the date of issuance of the construction permit (December 11, 1967) [ Reference a)]. Vermont Yankee's requested change [ Reference d)] extended the expiration date of the operating license to February 28, 2013, to reflect a 40-year p9riod of operation from the date of issuance of the full-term operating license (February 28, 1973)

During a recent discussion with NRC staff, Vermont Yankee was informed that the current NRC policy is to consider the 40-year period of operation to begin at the issuance of the first operating license following construction permit approval.

In the case of Vermont Yankee, this date would be the date of Vermont Yankee's low power license, issued on March 21, 1972.

This revision reflects a 40-year operating license period starting from the date of issuance of Vermont Yankee's low power operating license.

This revision is without prejedice to a further revision to this application, should the Commission revise its above-described policy prior to the allowance of this amendment request, or to a further amendment request should such a revision occur after that event.

The enclosure to this letter provides a revised page 7a of the facility's operating license reflecting an expiration date of March 21, 2012. We trust that this submittal is satisfactory; however, should you have any questions or-require further information concerning this submittal, please contact us.
