rhe matter has been on rhs 15 schedule for one week, however, we were forewd to move the 16 time from the afternoon up until the morning and. for that 17 reason. I think we ought to -- it would be prudent if we 18 voted to hold it.

It's a final rulemaking on Fitness For Duty programs.

23 The Cormission is being asked to approve a final Fitness 24 For Duty rule, which requires licensees authorized to 15 construct of operate nuclear power reactors to implement a

2 The program is intended to provide reasonable 3

asstrance that nuclear power plant personnel are reliable, i

4 trustworthy, and not under the influence of any substance, 1

5 legal or illegal, or mentally or physically impaired from l

6 any cause, which adversely affects their ability to safely 1

1 7

snd competently perform their duties.

3 Commissioners Roberts, Rogers and Curtiss have 9

approved the final rule as contained in SECY-89-33, 10 sub.4ect to deleting the modifications made by the staff to 11 section 2.7(g)(2) and restoring the section to the 12-original language approved by the Commission.

13 The staff modifications to section 2.7(g)(2)

-14 would have allowed presumptive positive results of 15 preliminary testing to be provided to a medical review 16 officer, who could then inform licensee management if he 17 or she concluded that the individuals presented a hazard 18 to self or others.
