s Issur sheet for Generic Letter Regarding Nonconforming Products and Dedication.of Commercial-Grade Products The staff has proposed a generic letter which requests licensees to take I
immediate action to evaluate their current procurement programs and implement any improvements necessary to reduce the likelihood of their use of nonconforming products.
Each licensee has 120-days to respond to this letter.
This request is being issued pursuant to 10 CFR 50.54(f) on the basis that it is to verify compliance with the current licensing basis for the facility.
In addition, the staff conditionally endorses EPRI NP-5652, " Guideline for the Utilization of Commercial Grade Items in Nuclear Safety Related Applications (NCIG-07)." Because of limited availability (3 copies) I have not enclosed it, but will provide a copy to you on request.
In reviewing the generic letter I believe it accurately reflects the existing _
staff position and regulatory basis for this issue, although the enclosure to the transmittal memorandum to E. Jordan states that staff regulatory positions are altered by this generic letter (see the response to question III).
I have discussed my concern with the staff and they are now looking into it.
If thic statement is correct a justification for requesting this information appears to be needed.
