Dear Ms. Bauman:

This letter responds to your July 17, 1989 appeals of the Nuclear Regulatory Comission's denial of portions of the records identified on Appendices G, H.

J and K of our June 9 and 29 responses to F01A-87-535.

In response to your appeal, the documents were re-reviewed. On the basis of this review, I affirm the Commission's initial decision.

The documents described in Appendix G were withheld under Exemption 7A of the Freedom of Information Act (FOIA), 5 U.S.C. 6 552(b)(7)(A) and 10 C.F.R. 6 9.17(a)(7)(1) of the Commission's regulations. The withheld information consists of investigatory records compiled for law enforcement purposes.

Dis-closure could reveal the scope, direction and focus of enforcement efforts, and could act to shield potential wrongdoing or violation of NRC requirements from investigations.

The information withheld from the documents described in Appendices I, J, and K has been withheld under Exemption 70, 5 U.S.C. % 552(b)(7)(D) and 10 C.F.R. 6 9.17(a)(7)(iv). The withheld information consists of names of individuals and other information the disclosure of which could reasonably be expected to reveal identities of confidential sources.

This letter represents final agency action on the above-captioned administra-tive appeals. Judicial review of the denial of documents or portions of docu-ments withheld is available in the Federal District Court in the district in which you reside or have your principal place of business, or in the Federal District Court of the District of Columbia.
